R2007-5,5_ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING AND IMPOSING A SEVENTY-FIVE DOLLAR ($75) APPLICATION FEE TO BE CHARGED TO RESPONDENTS REQUESTING AN ABATEMENT OF FINES PURSUANT TO AN ORDER OF THE CITY'S CODE ENFORCEMENT BOARD OR SPECIAL MAGISTRATE; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac (hereinafter referred to as "the City"), at its April 11, 2007 meeting, passed on first reading an ordinance amending the City's abatement procedure for fines imposed by the City's Code Enforcement Board or Special Magistrate; and WHEREAS, the ordinance provides that respondents seeking an abatement of fines shall be obligated to pay an application fee in an amount to be determined by the City Commission; and WHEREAS, the City Commission deems it to be in the best interest of the citizens and residents of the City to authorize and impose a seventy-five ($75) application fee for respondents seeking an abatement of fines pursuant to an order of the City's Code Enforcement Board or Special Magistrate. Reso. 11178 Page 2 of 3 April 16, 2007 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2. The City Commission of the City of Tamarac hereby authorizes and imposes a seventy-five dollar ($75) application fee for respondents seeking an abatement of fines pursuant to an order of the City's Code Enforcement Board or Special Magistrate. Section 3. All resolutions or parts of resolutions on in conflict herewith be, and the same are hereby repealed to the extent of such conflict. Section 4. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
