R-2007- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING CERTAIN COMPUTER AND TELECOMMUNICATIONS EQUIPMENT AS SURPLUS AND DIRECTING THAT EQUIPMENT BE DISPOSED VIA SALE THROUGH ESTABLISHED INTERNET MARKETS TO BE SELECTED; OR BY THE MEANS DEEMED TO BE MOST PRACTICABLE; PLACING ALL PROCEEDS INTO THE APPROPRIATE FUNDS FROM WHICH THE ASSETS WERE ORIGINALLY PURCHASED; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Manager may dispose of surplus stock by utilizing competitive sealed bids, public auction, established markets, sales at posted prices, donation, or trade-in as may be prescribed for the individual situation; and WHEREAS, pursuant to §6-153 of the Code of Ordinances, the City Commission may by Resolution direct the City Manager to dispose of surplus supplies by the method or methods deemed to be most advantageous, convenient, and economical to the City; and WHEREAS, the City of Tamarac periodically reviews its inventoryto identify surplus and obsolete equipment which has reached a sufficient level to warrant disposal, and WHEREAS, the City has certain computer and telecommunications equipment deemed to be surplus; and WHEREAS, the computer and telecommunications equipment may yet be useful to other entities or individuals, and WHEREAS, the City Manager has delegated the responsibility for Property Disposal to the Purchasing and Contracts Manager, through the Director of Finance; and Temp. Reso. 11212 Page 2 May 16, 2007 WHEREAS, the Director of Information Technology, the Director of Finance and Purchasing and Contracts Manager recommend that disposal of the surplus computer and telecommunications equipment be accommodated via an electronic established market available to all buyers via an Internet auction service to be selected: and WHEREAS, pursuant to §6-153, a list of assets available for disposal is attached hereto as Exhibit 1: and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the Citizens and residents to approve the sale of surplus computer and telecommunications equipment and to authorize the appropriate City officials to dispose of surplus computer and telecommunications equipment via an electronic established market available to all buyers via an Internet auction service; in the event that surplus computer and telecommunications equipment is not sold as a result of such auction, the City Commission of the City of Tamarac deems it to be in the best interest of the City to dispose of such surplus computer and telecommunications equipment in the means deemed most practicable as authorized pursuant to §6-153 of the City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The appropriate City Officials declare that the property in Exhibit 1 consists of surplus computer and telecommunications equipment and direct that property be disposed of via sale through established Internet markets. n I L Temp. Reso. 11212 Page 3 May 16, 2007 SECTION 3: In the event that the sale through established Internet markets is not successful, the City Manager is authorized to dispose of such surplus property in the means deemed most practicable as authorized pursuant to §6-153 of the City Code. SECTION 4: All proceeds from the auction or disposal shall be placed in the appropriate fund from which the assets were originally purchased to be used for public purposes. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable.
