R-2007- -11 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE PURCHASE AND INSTALLATION OF GUARDRAIL FROM WEEKLEY ASPHALT PAVING, INC., AT A COST NOT TO EXCEED $68,905.00, LOCATED AT MAINLANDS DRIVE, NW 79TH STREET AND WESTWOOD DRIVE, UTILIZING THE BROWARD COUNTY, FLORIDA PRICE AGREEMENT CONTRACT FOR THE GENERAL ROADWAY AND MISCELLANEOUS CONSTRUCTION, BID NO. H-Z-05- 376-131; APPROVING FUNDING FROM THE APPROPRIATE CAPITAL IMPROVEMENT ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, City Code Section 10-189(a) requires the installation of guardrail where pavement lies within twenty-five (25) feet of a canal, lake, or ditch for the protection of the public; and WHEREAS, the existing guardrails located at NW 79th Street, Westwood Drive, and Mainlands Drive no longer safely performs its function, and routine repair and maintenance is no longer sufficient due to the age and deterioration of the construction material ; and WHEREAS, sufficient funding exists for the purchase and installation of guardrail in the amount not to exceed $68,905.00 and WHEREAS, a contract currently exists for the purchase and installation of guardrail between Weekley Asphalt Paving, Inc., and Broward County, Florida, Bid No. H-Z-05-376- B1 for General Roadway and Miscellaneous Construction, a copy of said bid and price Temp. Reso. # 11214 Page 2 June 13, 2007 agreement is incorporated herein by reference and on file in the Office of the City Clerk; and WHEREAS, City Code Section 6-155 allows the Purchasing/Contracts Managerthe authority to procure supplies, material and equipment, which are the subject of contracts with other governmental agencies; and WHEREAS, it is the recommendation of the Director of Public Works and Purchasing/Contracts Manager to approve the purchase and installation of guardrail from Weekley Asphalt Paving, Inc., at a cost not to exceed $68,905.00, at NW 79th Street, Westwood Drive, and Mainlands Drive, utilizing the Broward County, Florida Price Agreement Contract Bid No. H-Z-05-376-131 for the General Roadway and Miscellaneous Construction; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve said purchase and installation of guardrail utilizing the Broward County, Florida Price Agreement Contract Bid No. H-Z-05-376-B1 for the Repair, Maintenance, and Installation of Roadway Systems. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The purchase and installation of guardrail from Weekley Asphalt Paving, Inc., at a cost not to exceed $68,905.00, at NW 79th Street, Westwood Drive, and Mainlands Drive, utilizing the Broward County, Florida Price Agreement Contract Bid No. H-Z-05-376-B1 for the Repair, Maintenance, and Installation of Roadway Systems, is hereby approved. 1 1 Temp. Reso. # 11214 Page 3 June 13, 2007 SECTION 3: Funding for the purchase and installation of guardrail in the amount not to exceed $68,905.00 is available in the Capital Improvement Program. SECTION 4: The appropriate City Officials are hereby authorized to expend an amount not to exceed $68,905.00 for the purchase and installation of guardrail ; and SECTION 5: All budget amendments for proper accounting purposes are hereby authorized. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
