R-2007- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DEMOSTRATING GENERAL SUPPORT FOR THE DRAFT MODEL PUBLIC SCHOOL FACILITIES ELEMENT AND RELATED PLAN PROVISION IN THE INTERGOVERNMENTAL COORDINATION AND CAPITAL IMPROVEMENT ELEMENTS; PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Sections 163.3180 and 163.3177, Florida Statutes, requires local governments to adopt or amend the Public School Facilities Element as well as the Intergovernmental Coordination and Capital Improvement Elements within the Comprehensive Plan in order to implement a countywide uniform system of public school concurrency; and WHEREAS, the Department of Community Affairs has made grant money available to local governments to assist them with the Comprehensive Plan amendments that are necessary to implement public school concurrency; and Temp Reso #11216 Page 2 May 25, 2007 WHEREAS, Broward County has received such grant funds to develop a Model Public School Facilities Element and related plan provisions in the Intergovernmental Coordination and Capital Improvement Elements; and WHEREAS, in order to satisfy the Department of Community Affair's grant requirements, the County has requested the general support of the municipalities within the County for the Draft Model Public School Facilities Element and related plan provision in the Intergovernmental Coordination and Capital Improvement Elements, hereby attached as Exhibit "A"; and WHEREAS, the Director of Community Development recommends demonstrating general support for the Draft Model Public School Facilities Element and related plan provisions in the Intergovernmental Coordinator and Capital Improvement Elements; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac, to authorize the appropriate City officials to demonstrate general support for the Draft Model Public School Facilities Element and Related plan provision in the Intergovernmental Coordination and Capital Improvement elements. 1 Fj Temp Reso #11216 Page 3 May 25, 2007 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The demonstration for general support for the Draft Model Public School Facilities Element and related plan provision in the Intergovernmental Coordination and Capital Improvement elements; is HEREBY APPROVED SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption. The C)unty, in collaboration with the School Board and the munici alities shall ensure that public school facilities are available for current and future students consistent with available financial resources and the ado ted LOS. Policy 14.7.1. Consistent with policies -and procedures within the ILA the DEFP shall contain a 5 year financial) feasible schedule of capital im rovements to address existin deficiencies and achieve and maintain the adopted LOS in all CSAs. Pursuant to Cha ter 163.3177 h F.S. the CoyptV, School Board and munici alities shall coordinate their plan2in and ermitting processes consistent with the procedure established within the ILA as follows. 1. Review and update of the annual DEFP containing the ftancially feasible schedule of ca ital im rovement for school facilities needed to achieve and maintain the adopted level of service stands in all CSAs. 2. Coordinate Count and munici al land use flanning and permittin rocesses with the School Board's site selection and plannin rocess to ensure future school facilities are consistent and compatible with land use categories and enable a close inte ration of between existin and tanned school facilities and the surroundin land uses. 3. Coordinate the re aration of County and munici al ro ections for future develo ment with the School Board's school enrollment roiections to ensure consistency between the Count and municipal future land use ma sand the 10n term school lanninprocess.
