A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE OFFICIALS
TO AWARD PHOTOCOPY EQUIPMENT LEASE
AND RENTAL AGREEMENTS TO TOSHIBA
BUSINESS SOLUTIONS ON BEHALF OF THE
SOUTHEAST FLORIDA GOVERNMENTAL
PURCHASING COOPERATIVE UTILIZING
PRICING PROVIDED THROUGH BROWARD
COUNTY TERM CONTRACT MASTER
PURCHASE AGREEMENT #G-8-06-318-B3 AND
CITY OF MIAMI CONTRACT #03-04-129(08); AND
STATE OF FLORIDA AGREEMENT 600-341-06-1,
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac needs to utilize photocopy equipment to
support all City operations; and
WHEREAS, in order to preserve environmental resources, the City has
embarked on a program to create electronic agenda packages for City
Commission meetings; and
WHEREAS, the use of photocopy equipment providing for scanning
capabilities will provide for an effective and efficient means to input electronic
agenda materials, thus promoting environmentally sound conservation practices
by the City; and

WHEREAS, the utilization of a term contract agreement provides for
volume savings through quantity discounts; and
WHEREAS, Broward County has competitively solicited and awarded
Agreement #G-8-06-318-B3 to Toshiba Business Solutions for the rental of
photocopy equipment as lead agency for the Southeast Florida Governmental
Purchasing Cooperative, a copy of said Agreement is on file with the City Clerk;
and
WHEREAS, the City of Tamarac is a member in good standing of the
Southeast Florida Governmental Purchasing Cooperative; and
WHEREAS, the City of Miami, Florida has awarded Contract 03-04-12(08)
to Toshiba Business Solutions for the Lease of photocopy equipment, a copy of
said Agreement is on file with the City Clerk; and
WHEREAS, the State of Florida has awarded Contract 600-341-06-1 for
the lease and purchase of photocopier equipment to Toshiba Business
Solutions, a copy of said Agreement is on file with the City Clerk; and
WHEREAS, City Code Section 6-155 allows the Purchasing and Contracts
Manager the authority to procure supplies, materials and equipment, which are
the subject of contracts with other governmental agencies without following
purchasing procedures as set forth in City Code Section 6-149; and
WHEREAS, City staff has been successful in negotiating pricing on behalf
of the entire City, for photocopy equipment with enhanced scanning capabilities,

utilizing the most advantageous pricing available from the Broward County, City
of Miami and the State of Florida Agreements; and
WHEREAS, as a result of these negotiations, the City will be able to meet
its needs for photocopy equipment with scanning capability within the City's
current budget constraints; and
WHEREAS, sufficient funds are available from all Departments' Operating
funds; and
WHEREAS, the Director of Information Technology and the Purchasing &
Contracts Manager recommend the acquisition of photocopy equipment using
the most advantageous pricing from the S.E. Florida Governmental Purchasing
Cooperative / Broward County Agreement # G-8-06-318-133, City of Miami
Contract #03-04-129(08), and the State of Florida Agreement #600-341-06-1
awarded to Toshiba Business Solutions and that the appropriate City Officials be
authorized to execute individual Agreements for each copier as best meets the
requirements of the individual department, between the City and Toshiba
Business Solutions, in accordance with the pricing summary included herein as
Exhibit 1; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
approve the acquisition of photocopy equipment for the City utilizing the Broward
County, City
of Miami and
State of Florida Agreements, and to
authorize the
appropriate
City Officials
to execute appropriate Agreements
with Toshiba

Business Solutions concurrent with the terms of the Broward County and City of
Miami Agreements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY
ratified and confirmed as being true and correct and are hereby made a specific
part of this Resolution upon adoption hereof.
SECTION 2: The appropriate City officials are hereby authorized to
utilize Broward County Agreement # G-8-06-318-133, City of Miami Agreement
03-04-129(08) and State of Florida Agreement # 600-341-06-1 for the most
appropriate and advantageous pricing for each individual City department
utilizing the aforementioned Agreements with Toshiba Business Solutions,
Tamarac, Florida, for City copier acquisitions for a period commensurate with the
terms of the respective Broward County, City of Miami and State of Florida
Agreements.
SECTION 3: All resolutions or parts of resolutions in conflict
herewith are HEREBY repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective immediately
upon its passage and adoption.
