RESOLUTION NO. R2007-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, DECLARING THE FLOOR -TO -
CEILING RETRACTABLE CURTAIN IN THE CITY
COMMISSION CHAMBERS AS BEYOND SURPLUS
STOCK AS DEFINED BY SECTION 6-153 OF THE CITY'S
CODE OF ORDINANCES; FINDING THAT THE
RETRACTABLE CURTAIN HAS NO ASCERTAINABLE
VALUE TO THE CITY; AUTHORIZING THE CITY
MANAGER OR HIS DESIGNEE TO DISPOSE OF THE
RETRACTABLE CURTAIN IN THE MANNER MOST
PRACTICAL AND BENEFICIAL TO THE CITY; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac City Commission Chamber at City Hall
has a floor -to -ceiling, retractable curtain affixed behind the dais to provide
protection from the sun and to block outside light in order to allow for
presentations and other eventualities that require darkness; and
WHEREAS, recently the curtain has lost its functional purpose and has
become a mechanical and visual nuisance in the City Commission Chamber; and
WHEREAS, since the curtain is no longer working properly or serving its
intended purpose, the City Commission desires to have it designated as part of
the City's surplus personal property pursuant to Section 6-153 of the City's Code
of Ordinances; and

WHEREAS, Section 6-153 expressly provides a process whereby the City
may dispose of surplus personal property; and
WHEREAS, the curtain has no ascertainable value to the City and is an
eyesore in the City Commission Chambers, and the City Commission desires to
authorize the City Manager or his designee to dispose of the curtain in the
manner determined to be most economically advantageous or cost neutral to the
City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA THAT:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
Section 2. The City Commission of the City of Tamarac hereby
determines that the floor -to -ceiling, retractable curtain affixed behind the dais in
the City Commission Chamber has no ascertainable value to the City, and
declares said curtain to be surplus property pursuant to Section 6-153 of the
City's Code of Ordinances. The City Commission further authorizes the City
Manager or his designee to dispose of the curtain in the manner determined to
be most economically advantageous and/or cost neutral to the City.

Section 3. All resolutions or parts of resolutions on in conflict herewith
be, and the same are hereby repealed to the extent of such conflict.
Section 4. If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

Section 5. This Resolution shall become effective immediately upon its
passage and adoption.
