RESOLUTION NO. R-2007- i
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING A REFUND OF $2,000.00 TO
DAVID BALDWIN OF FUN EXPEDITION OF
FLORIDA, DESIGNATED AGENT FOR B.E.M.
HOLDING CORPORATION FOR A SPECIAL
EXCEPTION APPLICATION FEE, COLLECTED
FOR THE TAMARAC FUN EXPEDITION
PROJECT (CASE NO. 10-MI-07); PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on January 2, 2007 David Baldwin of Fun Expedition of Florida,
Designated Agent for B.E.M. Holding Corporation, submitted a Special Exception
application to the Community Development Department with a check in the amount of
$2,000.00 for a Special Exception application fee for the Tamarac Fun Expedition project;
and
WHEREAS, on June 5, 2007 a request letter was sent to the City of Tamarac for
reimbursement of the Special Exception application fee (attached hereto as Exhibit "1 ");
and
WHEREAS, the Community Development Department staff has determined that the
Special Exception application fee of $2,000.00 paid by David Baldwin of Fun Expedition of
Florida, Designated Agent for B.E.M. Holding Corporation, should be refunded since no
staff time or resources were used to process the application (attached hereto as Exhibit
"2"); and

WHEREAS, the Director of Community Development recommends approval of the
refund; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize a refund
in the amount of $2,000.00 to David Baldwin of Fun Expedition of Florida, Designated
Agent for B.E.M. Holding Corporation for the Special Exception application fee, collected
for the Tamarac Fun Expedition project (Case No. 10-MI-07).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to refund the Special Exception application fee for the Tamarac Fun
Expedition project in the amount of $2,000.00 made payable to David Baldwin of Fun
Expedition of Florida, 649 Willow Bend Road, Weston, Florida 33327.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or in application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
adoption.

Mrs. Jennifer Bramley:
On December 30, 2006, Fun Expedition of Florida submitted a Check to City of
Tamarac in the amount of 2,000.00 dollars for a special exception review of Furniture
Power located on University Avenue in Tamarac. We have decided not to use this
building. At this time we are asking for our money to be refunded- We did not utilize any
of the special exception pleadings.
