RESOLUTION NO. R-2007---�J
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
A VACATION OF EASEMENT TO VACATE
THREE (3) EASEMENTS LYING IN THE
"TAMARAC BUSINESS CENTER SECTION 2°
PLAT (PLAT BOOK 61, PAGE 50), LOCATED AT
THE SOUTHEAST CORNER OF COMMERCIAL
BOULEVARD AND STATE ROAD 7/US
441;(CASE NO. 1-P-07) PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Easements were dedicated to the public on January 1, 1978 at the
time of the recordation of the Plat; and
WHEREAS, the property owner FPIP XIV, LLC and George A. Morgan III aka Trey
Morgan has determined that the vacation of three (3) utility easements lying in the
"TAMARAC BUSINESS CENTER SECTION 2" (Plat Book 61, Page 50), located at the
southeast corner of Commercial Boulevard and State Road 7/US 441, is no longer
necessary due to a previous site configuration which was subsequently abandoned; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of the abandoned utility
easements to facilitate any future improvements; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board recommended approval on June 6, 2007; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant a Vacation of
Easement of three (3) utility easements located at the southeast corner of Commercial
Boulevard and State Road 7/US 441, according to the Plat thereof as recorded in Plat
Book 61, Page 50 of the Public Records of Broward County, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the Vacation of Easement of a portion of the existing
abandoned utility easements located at the southeast corner of Commercial Boulevard
and State Road 7/US 441 according to the Plat thereof as recorded in Plat Book 61,
Page 50 of the Public Records of Broward County, Florida; is HEREBY GRANTED.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
adoption.
