R-2007- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING AND AUTHORIZING AN INCREASE IN THE HOURLY RATE OF COMPENSATION FOR THE CITY'S SPECIAL MAGISTRATES FROM ONE HUNDRED DOLLARS ($100.00) PER HOUR TO ONE HUNDRED TWENTY- FIVE ($125.00) PER HOUR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 26, 2000, the City Commission of the City of Tamarac, Florida (hereinafter referred to as the "City") adopted Resolution No. R-2000-32, appointing Mark E. Berman, Eugene M. Steinfeld, and Alan L. Gabriel to serve as the City's Special Magistrates for the purpose of code enforcement; and WHEREAS, the Special Magistrates were appointed at a rate of one hundred dollars ($100.00) per hour; and WHEREAS, less urban parts of the State of Florida, including the City of Alachua, are advertising the position of Special Magistrate starting at a rate of one hundred twenty-five dollars ($125.00) per hour; and WHEREAS, the City Commission, in an effort to remain competitive, deems it to be in the best interests of the City to increase the hourly rate of the City's Special Magistrates from one hundred dollars ($100.00) per hour to one hundred twenty-five ($125.00) per hour. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Temp. Reso. 11230 Page 2 of 4 June 15, 2007 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2. The City Commission of the City of Tamarac hereby approves and authorizes an increase in the hourly rate of compensation for the City's Special Magistrates from one hundred dollars ($100.00) per hour to one hundred twenty-five ($125.00) per hour. Section 3. All resolutions or parts of resolutions on in conflict herewith be, and the same are hereby repealed to the extent of such conflict. Section 4. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 5. This Resolution shall become effective immediately upon its passage and adoption. 1 Temp.
