R-2006-- a5_ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE DELAYED ENFORCEMENT OF CODE ENFORCEMENT MATTERS DUE TO HURRICANE WILMA; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 24, 2005, properties throughout the City of Tamarac sustained damage caused by Hurricane Wilma; and WHEREAS, due to the impact of Hurricane Wilma, the City Commission reached consensus to authorize a ninety (90) day suspension of all code enforcement hearings; and WHEREAS, at the City Commission workshop on December 12, 2005, City Staff presented a recommended plan of action for delayed enforcement of code enforcement matters in accordance with a specified schedule in orderto more effectively address issues caused by or otherwise delayed by Hurricane Wilma; and WHEREAS, while the City Commission intends to continue to strictly enforce its Code of Ordinances in order to maintain the high level of safety and quality of life its residents and businesses have come to expect, the City Commission understands the difficulties experienced by its residents and businesses as a result of Hurricane Wilma; and Temp Reso #10881 12/27/2005 12/28/05 Rev#1 1 /3/06 Rev #2 Page 2 WHEREAS, the City Commission desires to be understanding of the hardships its residents and businesses have experienced due to the storm and desires to assist these residents and businesses by delaying the enforcement of such code enforcement matters. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials hereby authorize the delayed enforcement of code enforcement matters in accordance with the enforcement schedule presented by City Staff to the City Commission at the City Commission workshop meeting on December 12, 2005, as provided in the attached Exhibit "A." SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
