R-2006-115 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUNSETTING THE CONSUMER AFFAIRS COMMITTEE EFFECTIVE IMMEDIATELY UPON PASSAGE AND ADOPTION OF THIS RESOLUTION, FOR A MINIMUM OF ONE YEAR, OR UNTIL IT IS DETERMINED THAT THEIR SERVICES ARE NEEDED; EXTENDING APPRECIATION TO THE CONSUMER AFFAIRS COMMITTEE AND COMMENDING THE MEMBERS OF THE CONSUMER AFFAIRS COMMITTEE FOR THEIR EFFORTS ON BEHALF OF THE CITY OF TAMARAC; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Consumer Affairs Committee, was established in 1975 for the purpose of developing and activating programs designed for the protection of residents of the City of Tamarac in connection with purchases of residences, goods and services, to receive and process consumer complaints and take or recommend necessary and appropriate action with respect thereto; recommend ordinances or resolutions designed to protect consumers; cooperate with other similar governmental agencies; and perform such other similar duties as may be prescribed by resolution of the City Commission; and WHEREAS, the Consumer Affairs Committee has, over the years, provided a much needed service to the residents of the City of Tamarac; and WHEREAS, over the past few years the Consumer Affairs Committee has struggled to garner a quorum for its meetings and has struggled to maintain staffing for the Consumer Affairs Office; and Page 2 Temp. Reso. #10998 June 19, 2006 WHEREAS, Broward County provides the same service to the residents of the City of Tamarac that the Consumer Affairs Committee has provided, albeit, on a larger scale; and WHEREAS, the members of the Consumer Affairs Committee have determined that it would be in the best interests of the residents of the City of Tamarac and the members of the Consumer Affairs Committee to sunset the Committee for a minimum of one year, or until it is determined that their services are needed; and WHEREAS, the City Commission of the City of Tamarac extends its appreciation to the members of the Consumer Affairs Committee, and commends said members for their efforts on behalf of the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to sunset the Consumer Affairs Committee effective immediately upon the passage and adoption of this Resolution for a minimum of one year or until it is determined that their services are needed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing WHEREAS clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac extends its appreciation to the Consumer Affairs Committee and commends the members of the 1 1 1 Page 3 Temp. Reso. #10998 June 19, 2006 Consumer Affairs Committee for their efforts on behalf of the City of Tamarac. SECTION 3: That the Consumer Affairs Committee is hereby sunsetted effective immediately upon passage and adoption of this Resolution for a minimum of one year, or until it is determined that the services of the Consumer Affairs Committee is needed. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this 28th day of June 2006.
