R2006-119 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING TWO REGULAR MEMBERS TO THE PLANNING BOARD TO SERVE THREE-YEAR TERMS EXPIRING APRIL 15, 2009; APPOINTING THREE REGULAR MEMBERS TO THE PLANNING BOARD TO FILL UNEXPIRED TERMS ENDING APRIL 15, 2007; APPOINTING TWO ALTERNATE MEMBERS TO THE PLANNING BOARD TO SERVE ONE-YEAR TERMS EXPIRING APRIL 15, 2007; PROVIDING FOR AN EX OFFICIO, NON -VOTING MEMBER DESIGNATED BY THE BROWARD COUNTY SCHOOL BOARD; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission is desirous of appointing two regular members to the Planning Board to serve three-year terms expiring April 15, 2009, three regular members to the Planning Board to fill unexpired terms ending April 15, 2007; and two alternate members to the Planning Board to serve one- year terms expiring April 15, 2007; and WHEREAS, in accordance with Sections 24-61(a) and (b) of the Tamarac Code regular members of the Planning Board shall be appointed by the City Commission to serve three-year terms expiring on April 15th of the appropriate year, and alternate members shall be appointed by the City Commission to serve one-year terms expiring on April 15th of the appropriate year; and WHEREAS, the resignations of one regular member in February 2006 and one regular member effective August 1, 2006, as well as the passing of one regular member of the Planning Board has resulted in three unexpired terms Temp. Reso. #10930 Page 2 of 4 February 10, 2006 Revision #1 06/21 /06 Revision #2 — 06/28/06 ending April 15, 2007; said unexpired terms required to be filled by appointment of three regular members by the City Commission for terms ending April 15, 2007; and WHEREAS, Section 24-61(a) of the Tamarac Code provides for an ex officio, non -voting member of the Planning Board designated by the School Board of the County in accordance with F.S. 163.3174; and WHEREAS, the Community Development Director and City Manager recommend approval; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint two regular members to the Planning Board to serve three-year terms expiring April 15, 2009, three regular members to the Planning Board to fill unexpired terms ending April 15, 2007, and two alternate members to the Planning Board to serve one-year terms expiring April 15, 2007. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Section 24-61(a) of the Tamarac Code, the following people are hereby appointed as regular members of the Planning Board 1-1 1 to serve three-year terms expiring April 15, 2009, reappointments are made: Joan Hinden Temp. Klombers SECTION 3: That pursuant to Section 24-61(a) of the Tamarac Code, the following people are hereby appointed as regular members of the Planning Board, said terms to commence immediately upon approval and adoption of this Resolution, to fill unexpired terms ending April 15, 2007, or until such time as reappointments are made: Walter Siegel Stan Sudler SECTION 4: That pursuant to Section 24-61(a) of the Tamarac Code, the following person is hereby appointed as a regular member of the Planning Board, said term to commence August 1, 2006, to fill an unexpired term ending April 15, 2007, or until such time as reappointments are made: Dana Feather SECTION 5: That pursuant to Section 24-61(b) of the Tamarac Code, the following people are hereby appointed as alternate members of the Planning Board to serve one-year terms expiring April 15, 2007, or until such time as reappointments are made: Godwin Graham Pamela T. LeMelle SECTION 6: That pursuant to Section 24-61(a) of the Tamarac Code, the School Board shall designate an ex officio, non -voting member to sit on the City of Tamarac Planning Board. Temp. Reso. #10930 Page 4 of 4 February 10, 2006 Revision #1 06/21 /06 Revision #2 — 06/28/06 SECTION 7: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 8: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
