R-2006--L3.2, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE CHANGE ORDER NUMBER 2 TO THE AGREEMENT BETWEEN THE CITY OF TAMARAC AND TENEX ENTERPRISES, INC. FOR THE CONSTRUCTION OF ENTRY WALLS AT EACH OF THE SOUTHEAST AND SOUTHWEST CORNER OF NW 100T" TERRACE AND NW 103RD AVENUE ALONG SOUTHGATE BLVD.; AUTHORIZING AN ADDITIONAL EXPENDITURE IN AN AMOUNT NOT TO EXCEED $54,821.82 FOR SAID PURPOSE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on December 14, 2005 the City Commission approved the award of Bid No, 05-19B to Tenex Enterprises, Inc. for the Southgate Blvd. Streetscape Improvement Project through Resolution R-2005-236, a copy of said Resolution attached hereto as Exhibit 1; and WHEREAS, the construction of Southgate Blvd. Streetscape Improvement Project is from Nob Hill Road West to the end of the road; and WHEREAS, in order to accommodate the reconfiguration of roadway under Southgate Blvd. Streetscape Improvement Project, the City of Tamarac Public Works Department decided to construct entry wall at each of the southeast and southwest comer of NW 100t' Terrace and NW 103rd Avenue. These walls will enhance the aesthetics of the community while providing increased safety and privacy for the residents that live at that comers; and WHEREAS, Tenex Enterprises, Inc. submitted a proposal for these entry walls construction, a copy of said proposal attached hereto as Exhibit 2; and Temp Reso. # 11007 July 3, 2006 Page 2 WHEREAS, Public Works staff has reviewed said proposal and have determined that the pricing is competitive and acceptable; and WHEREAS, the cost of this change order necessitates an additional expenditure in an amount not to exceed $54,821.82, a copy of Change Order No. 2 attached hereto as Exhibit 3; and WHEREAS, funding for this Change Order No.2 is available in the Project Contingency Allowance; and WHEREAS, the Director of Public Works and Purchase/Contracts Manager recommend the authorization of Change Order No.2 to the Southgate Blvd. Streetscape Improvement Project in an amount not to exceed $54,821.82; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the Citizens and residents of the City of Tamarac to approve Change Order No. 2 to the Southgate Blvd. Streetscape Improvement Project and authorize an additional expenditure in an amount not to exceed $54,821.82 for said purpose. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution upon adoption hereof. SECTION 2: The appropriate City Officials are HEREBY AUTHORIZED to execute the Change No.2 to the Contract with Tenex Enterprises, Inc. for the construction of entry wall at each of the southeast and southwest corner of NW 100th Terrace and NW 103rd Avenue along Southgate Blvd. 1 1 Temp Reso. # 11007 July 3, 2006 Page 3 SECTION 3: An additional expenditure in an amount not to exceed $54,821.82 for this purpose is HEREBY approved. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. SECTION 5: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or application, and to this end the provisions of this resolution are declared to be severable. Reso. 10834 12/01 /05 Rev. #1-12/07/05 Page 2 WHEREAS, September 28, 2005, four (4) bids were opened and reviewed in order to determine cost and responsiveness to the City's technical specifications; and WHEREAS, Tenex Enterprises, Inc. provided the most responsive and responsible bid for the Southgate Boulevard Streetscape Improvement Project, a continuance of the Seven Year Comprehensive Street Improvement Program, a copy of the bid tabulation (Exhibit #3) and Bid (Exhibit #2) are hereto attached; and WHEREAS, available funds exist in the Seven Year Comprehensive Street Improvement Program and Stormwater Capital Improvement budget for the aforesaid purpose; and WHEREAS, the Director of Public Works and Purchasing and Contracts Manager recommend that the City award Bid No. 05-19B to and authorize appropriate City officials to execute agreement (Exhibit #4) with Tenex Enterprises, Inc. for the Southgate Boulevard Streetscape Improvement Project, a continuance of the Seven Year Comprehensive Street Improvement Program in the amount of $1,239,469.26; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to award Bid #05-19B to Tenex Enterprises, Inc, for the Southgate Boulevard Streetscape Improvement Project, a continuance of the Seven Year Comprehensive Street Improvement Program and authorize an expenditure in an amount not to exceed $1,239,469.26. SECTION 6: The City Manager is hereby authorized to make additions, deletions or revisions to the Seven Year Comprehensive Street Improvement Program pursuant to Section 6-156 of the Code of the City of Tamarac. SECTION 7: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp.
