R-2006- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ALLOCATING ONE -HUNDRED TWENTY (120) FLEXIBILITY UNITS TO THE MAIN STREET VILLAGE PROJECT ZONED MXD (MIXED -USE DISTRICT) COMPRISING APPROXIMATELY 5.36 ± ACRES AND LOCATED BETWEEN NW 91 ST AVENUE AND NW 94TH AVENUE, NORTH OF COMMERCIAL BOULEVARD AND SOUTH OF NW 57T" STREET WITHIN THE CITY OF TAMARAC, BROWARD COUNTY, FLORIDA (CASE NO. 12-MI-06); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has received a New Development Site Plan application known as the Main Street Village project consisting of one -hundred twenty (120) residential dwelling units and approximately 53,892 square feet of retail and restaurant use; and WHEREAS, the property owner, Bernie Maribona of B. Commercial Inc., requests that the City of Tamarac allocate one -hundred twenty (120) flexibility units of the remaining 192 units available in Flex Zone 62; and WHEREAS, in accordance with Broward County Land Use Plan Policy 13.01.10, the contiguous municipalities of the City of Sunrise and City of Lauderhill were notified of the proposed project and correspondence was received indicating a "Compatibility Review and Public School Impact Review" was not requested; and WHEREAS, the proposed allocation is in conformance with the City's Temp Reso #11016 —July 17, 2006 Page 2 l Comprehensive Plan and the Broward County Land Use Plan; and WHEREAS, the Planning Board held a meeting on June 21, 2006 and recommended approval of the proposed New Development Site Plan application; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to allocate one - hundred twenty (120) flexibility units to the Main Street Village project zoned MXD (Mixed - Use District) comprising approximately 5.36 ± acres and located between NW 915t Avenue and NW 94'th Avenue, north of Commercial Boulevard and south of NW 57th Street, within the City of Tamarac, Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the allocation of one -hundred twenty (120) flexibility units to the Main Street Village Project zoned MXD (Mixed -Use District) comprising approximately 5.36 ± acres and located between NW 91 st Avenue and NW 94t" Avenue, north of Commercial Boulevard and south of NW 57th Street within the City of Tamarac, Broward County, Florida, is hereby granted. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. F Temp Reso #11016 — July 17, 2006 Page 3 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption.
