R- 2006-� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA SUPPORTING THE FLORIDA COALITION FOR SAFE HIGHWAYS AGAINST INCREASES IN TRUCK SIZE AND WEIGHT TO REDUCE THE NUMBER OF HIGHWAY DEATHS AND ISSUES WHICH THREATEN HIGHWAY SAFETY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The Florida Coalition for Safe Highways is comprised of citizen, community, labor and professional organizations representing millions of motorists who oppose increases in truck size and weight; and WHEREAS, The Florida Coalition for Safe Highways is seeking support of their efforts to make roads safer in Florida and reduce the number of highway deaths by fighting against the efforts of larger truck proponents to increase truck lengths and weights; and WHEREAS, the State of Florida contains important transportation highways and interstates that are heavily used by trucks and motorists traveling to and from southern Florida; and WHEREAS, according to the US Department of Transportation, National Bridge Inventory, 2000 data shows 14% of Florida's bridges are considered to be "structurally deficient" or "functionally obsolete"; and WHEREAS, the August 2000 U.S. Department of Transportation Comprehensive Truck Size and Weight Study found that: 1) Longer Combination Vehicles (LCVs)-long double and triple trailer trucks are at least 11 % more likely to be involved in a fatal accident, and 2) heavier single trailer trucks are more likely to experience dangerous Temp. Reso. # 11028 9/7/2006 Page 2 Revision #1- September 5, 2006 rollover and braking problems, and 3) longer and heavier trucks would mean $319 billion in national budget costs; and WHEREAS, according to the United States Department of Transportation, the damage caused by heavier trucks is not covered by taxes paid by trucking companies; a typical trailer truck pays only 70% of its federal highway costs; U.S. taxpayers make up the difference; and WHEREAS, a recent report by the United States Department of Transportation states that the Department "recommends against any truck size and weight increases"; and WHEREAS, the Fire Chief recommends the City of Tamarac support the Florida Coalition for Safe Highways efforts to make roads safer in Florida by fighting against the efforts of larger truck proponents to increase truck lengths and weights; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to support the Florida Coalition for Safe Highways in their efforts against increases in truck size and weight, and opposes any effort at any level of government to allow for larger and heavier trucks on our Nation's highways. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The City of Tamarac hereby supports the Florida Coalition for Safe Highways in their efforts against increases in truck size and weight, and opposes any effort at any level of government to allow for larger and heavier trucks on our Nation's highways. 1 1 1 Temp. Reso. # 11028 9/7/2006 Page 3 Revision #1- September 5, 2006 SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict SECTION 4: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the, provisions of this Resolution are declared to be severable. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 13th day of r 2006.
