CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2006- 103
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO INCREASE THE
WATER AND SEWER CONTRIBUTION IN AID OF
CONSTRUCTION (CIAC) CHARGES AS ESTABLISHED;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 22-189 of the Tamarac City Code requires that developers
contribute a portion of the cost of utility facilities as contribution charges; and
WHEREAS, the Tamarac City Commission last authorized an increase in the
contribution charges in 1998, through R-98-136, changing the water contribution charge of
$1,205.00 per equivalent residential connection (ERC) to $1,400.00 and the wastewater
contribution charge of $1,550.00 per ERC to $1,800.00; and
WHEREAS, ERC basis is defined as the maximum demand of three hundred fifty
(350) gallons per day which equates to the demand for a single-family dwelling unit; and
WHEREAS, these CIAC fees are collected and accounted for in a separate
enterprise fund and these monies are utilized for projects which expand the capacity of
Tamarac's water and sewer systems; and
WEREAS, at the August 21, 2006 Commission Workshop, a presentation was made
regarding long-term Utilities needs; and

WHEREAS, the projected CIAC fee revenue at the current rates will not be
adequate to meet financing requirements for projects such as a potential reverse osmosis
water treatment plant to meet the projected water supply needs for future growth; and
WHEREAS, the Director of Utilities and Director of Financial Services recommend
that the appropriate City Officials increase the CIAC fees to the rate of $1,700.00 for the
water system and $2,200.00 for the sewer system; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to increase the CIAC
fees to the rate of $1,700.00 for the water system and $2,200.00 for the sewer system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution
upon adoption hereof.
SECTION 2: The appropriate City Officials are hereby authorized to increase
CIAC fees from $1,400.00 to $1,700.00 for the water system and from $1,800.00 to
$2,200.00 for the sewer system.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or application; it shall not affect the validity of the remaining portions or applications of
this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
