R-2006- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING BROWARD COUNTY IN THEIR EFFORTS TO SECURE PERMITS FROM THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT TO DEVELOP THE GREENWAY CORRIDOR PROJECT WITHIN THE CITY OF TAMARAC; ACKNOWLEDGING THE CITY'S COMMITMENT TO VARIOUS AREAS OF APPLICANT RESPONSIBILITY IN MAINTAINING THE LANDSCAPING AND OTHER FACILITIES OF THE GREENWAY CORRIDOR PROJECT WITHIN THE CITY OF TAMARAC TO THE SATISFACTION OF THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Broward County is in the process of developing an inter- connected greenway system throughout the County; and WHEREAS, a portion of the system, the Cypress Creek/C-14 corridor, lies within the City of Tamarac's municipal boundaries; and WHEREAS, Broward County will be securing various permits for the project including those required by the South Florida Water Management District (SFWMD); and WHEREAS, SFWMD has indicated that they may request that governmental entities' applications for permit requests be supported with a Resolution acknowledging that the applicant is making various commitments; and Temp. Reso. #11081 October 4, 2006 Page 2 WHEREAS, the City of Tamarac wishes to support Broward County in their efforts to secure permits from the South Florida Water Management District to develop the Greenway corridor within the City of Tamarac; and and WHEREAS, the Director of Parks and Recreation recommends approval; WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to support Broward County in their efforts to secure permits from the South Florida Water Management District to develop the Greenway corridor within the City of Tamarac . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: That the City of Tamarac supports Broward County in their efforts to secure permits from the South Florida Water Management District (SFWMD) to develop the Greenway corridor project within the City of Tamarac. Reso. #11081 October 4, 2006 Page 3 SECTION 3: The City of Tamarac acknowledges its commitment to various areas of applicant responsibility in maintaining the landscaping and other facilities of the greenway corridor project within the City of Tamarac to the satisfaction of the SFWMD including: • Being willing and financially capable of maintaining the landscaping and other facilities; • Removing and trimming landscaping in a timely manner when requested to do so by the SFWMD; • Assuming responsibility for complying with any applicable tree ordinances and not attempting to using such ordinances as a means to keep trees which the SFWMD deems must be removed; • Keeping in mind that a clear access pathway must be preserved for SFWMD maintenance and equipment; • At least 98% of the plantings used must be on the SFWMD approved plant list with no noxious or undesirable species; • Taller trees and plants must be set back from the top of the canal bank in order that they do not fall into the canal if they topple during a hurricane or windstrom; • No above -ground enroachments of a permanent and/or semi- permanent nature are allowed within 40 feet of the top of the canal bank; and • To work with area residents to obtain the residents' support for the greenway project and provide the SFWMD with information regarding the results of the meeitngs. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
