R-2006-,;g, je"k A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO AWARD BID #06-31 B AND EXECUTE AN AGREEMENT WITH CONCHO HORTICULTURAL, INC. FOR THE PURCHASE OF TREES FOR AN AMOUNT NOT TO EXCEED $75,000.00 FROM THE APPROPRIATE ACCOUNTS; AUTHORIZING BUDGET AMENDMENTS FOR PROPER ACCOUNTING PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to provide for the reforestation of public rights -of -way within the City as a result of tree loss from hurricanes Jeanne and Francis; and WHEREAS, the City has been awarded a 2005 Emergency Hurricane Supplemental Urban and Community Forestry Grant through the State of Florida Department of Agriculture and Consumer Services; and WHEREAS, the City publicly advertised Bid #06-31 B for the purchase and delivery of trees as determined by the City's certified arborist; and WHEREAS, Invitation to Bid #06-31 B, which a copy is on file in the City Clerk's Office; and WHEREAS, on September 27, 2006, three (3) bids were opened and reviewed in order to determine cost and responsiveness to the City's technical specification; and Temp. Reso. # 11093 October 17, 2006 Page 2 WHEREAS, a copy of the bid tabulation showing all bids for Bid #06-31 B is included herein as Exhibit "1 "; and WHEREAS, Concho Horticultural, Inc., the lowest responsive and responsible bidder, submitted a bid for supply and delivery of trees pursuant to the Terms & Conditions, Special Conditions, and Technical Specifications of Bid #06-31 B for an amount of $71,290.00; and WHEREAS, the Public Works Director, Public Works Operations Manager, and Purchasing and Contracts Manager recommend that the appropriate City Officials enter into an Agreement to utilize Concho Horticultural, Inc., for supply and delivery of trees, a copy of said Agreement which is on file in the City Clerk's office; and WHEREAS, funding in the amount of up to $75,000.00, is available through the Urban and Community Forestry Grant program Application No. 051-1-162 awarded to the City and authorized by the City through resolution No. 2005-15, dated June 22, 2005; and WHEREAS, the Director of Public Works and Purchasing and Contracts Manager recommend that the appropriate City officials execute the agreement between Concho Horticultural, Inc., and the City to supply and deliver trees for the reforestation of the City rights -of -way; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to provide for reforestation using the prices, terms, and conditions of the agreement with Concho Horticultural, Inc. Temp. Reso. # 11093 October 17, 2006 Page 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The award of Bid #06-31 B to Concho Horticultural, Inc. is HEREBY approved for an amount not to exceed $75,000.00. SECTION 3: That the appropriate City Officials are HEREBY authorized to execute an agreement with Concho Horticultural, Inc., and which a copy is on file in the City Clerk's Office. SECTION 4: All budget amendments for proper accounting purposes are hereby approved. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or Temp. Reso. # 11093 October 17, 2006 Page 4 application, and to this end the provisions of this Resolution are declared to be severable.
