R-2006-� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE PUMPS AND APPURTENANCES FROM ABS PUMPS, INC., A SOLE SOURCE SUPPLIER, FOR THE MAINTENANCE AND REPLACEMENT OF FIFTY-ONE (51) OF THE CITY'S EIGHTY-ONE (81) WASTEWATER PUMP STATIONS; AUTHORIZING AN EXPENDITURE FOR SAID PURPOSE IN AN AMOUNT NOT TO EXCEED $75,000 FOR FISCAL YEAR 2007; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Utilities Department currently operates and maintains eighty-one (81) wastewater pump stations; and WHEREAS, fifty-one (51) of these stations utilize pumps and appurtenances manufactured by ABS Pumps, Inc.; and WHEREAS, the compatibility of pumps and appurtenances with originally installed equipment is necessary due to unique physical constraints within the wastewater pump stations, requiring the use of specialized equipment only available through ABS Pumps, Inc. (a copy of said justification attached hereto as "Exhibit 1 "); and WHEREAS, the purchase of pumps from other manufacturers would require the City to perform expensive renovations of the pump stations; and Temp. Reso. #11094 October 19, 2006 Page 2 of 4 WHEREAS, standardization of pump equipment is desirable in order to maintain continuity of replacement parts; and WHEREAS, ABS Pumps, Inc., is the sole source supplier of compatible equipment with the original pumps and the City 's specifications for submersible pumps; and WHEREAS, City of Tamarac Code § 6-151 grants the authority to waive competitive bid requirements for the purchase of supplies and services available from a sole source; and WHEREAS, the cost of said pumps and appurtenances from ABS Pumps, Inc. is both fair and reasonable and is equal to or better than what would be extended to another customer with similar needs; and WHEREAS, available funds exist in the appropriate Utilities Capital Improvement Program and Operating budgets for said purpose; and WHEREAS, the Director of Utilities and the Purchasing and Contracts Manager recommend that the appropriate City Officials authorize the purchase of pumps and appurtenances from ABS Pumps, Inc., a sole source manufacturer, for the repair and maintenance of fifty-one (51) of the City's eighty-one (81) wastewater pump stations in an amount not to exceed $75,000 for Fiscal Year 2007; and Temp. Reso. #11094 October 19, 2006 Page 3 of 4 WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to purchase pumps and appurtenances from ABS Pumps, Inc., as a sole source provider for said supplies, in a Fiscal Year 2007 amount not to not to exceed $75,000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The appropriate City Officials are hereby authorized to purchase pumps and appurtenances for the maintenance and repair of fifty-one (51) wastewater pump stations from ABS Pumps, Inc., a sole source provider of said supplies. SECTION 3: An expenditure for said purpose in an amount not to exceed $75,000 for Fiscal Year 2007 is hereby approved. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. n i Temp.
