RESOLUTION NO. R-2006- a��
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE THE
PURCHASE AND INSTALLATION OF GUARDRAIL
AND BARRIER WALL FROM WEEKLEY ASPHALT
PAVING, INC., AT A COST NOT TO EXCEED
$46,900.00, LOCATED AT MAINLANDS DRIVE AND
COMMERCIAL BOULEVARD, UTILIZING THE
BROWARD COUNTY, FLORIDA PRICE AGREEMENT
CONTRACT FOR THE GENERAL ROADWAY AND
MISCELLANEOUS CONSTRUCTION, BID NO. H-Z-05-
376-131; APPROVING FUNDING FROM THE
APPROPRIATE CAPITAL IMPROVEMENT ACCOUNT;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, City Code Section 10-189(a) requires the installation of guardrail where
pavement lies with twenty-five (25) feet of a canal, lake, or ditch for the protection of the
public; and
WHEREAS, the existing guardrail and barrier wall located on Mainlands Drive
immediately south of Commercial Boulevard no longer safely performs its function, and
routine repair and maintenance is no longer sufficient due to the age and deterioration
of the construction material ; and
WHEREAS, sufficient funding exists for the purchase and installation of guardrail
and barrier wall in the amount not to exceed $46,900.00 and
WHEREAS, a contract currently exists for the purchase and installation of guardrail
and barrier wall between Weekley Asphalt Paving, Inc., and Broward County, Florida, Bid

No. H-Z-05-376-131 for General Roadway and Miscellaneous Construction, a copy of said
bid and price agreement is on file in the office of the City Clerk; and
WHEREAS, Weekley Asphalt Paving, Inc., has agreed to the terms and conditions
of the Broward County bid to the City of Tamarac, attached hereto as Exhibit 1; and
WHEREAS, City Code Section 6-155 allows the Purchasing/Contracts Manager the
authority to procure supplies, material and equipment, which are the subject of contracts
with other governmental; and
WHEREAS, it is the recommendation of the Director of Public Works and
Purchasing/Contracts Manager to approve the purchase and installation of guardrail and
barrier wall from Weekley Asphalt Paving, Inc., at a cost not to exceed $46,900.00, at
Mainlands Drive and Commercial Boulevard, utilizing the Broward County, Florida Price
Agreement Contract Bid No. H-Z-05-376-B1 for the General Roadway and Miscellaneous
Construction; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve said
purchase and installation of guardrail and barrier wall utilizing the Broward County, Florida
Price Agreement Contract Bid No. H-Z-05-376-131 for the Repair, Maintenance, and
Installation of Roadway Systems.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The purchase and installation of guardrail and barrier wall from
Weekley Asphalt Paving, Inc., at a cost not to exceed $46,900.00, at Mainlands Drive and

Commercial Boulevard, utilizing the Broward County, Florida Price Agreement Contract Bid
No. H-Z-05-376-131 for the Repair, Maintenance, and Installation of Roadway Systems, is
hereby approved.
SECTION 3: Funding for the purchase and installation of guardrail and
barrier wall in the amount not to exceed $46,900.00 is available in the Stormwater Fund.
SECTION 4: The appropriate City Officials are hereby authorized to expend
an amount not to exceed $46,900 for the purchase and installation of guardrail and barrier
wall; and
SECTION 5: All budget amendments for proper accounting purposes are
hereby authorized.
SECTION 6: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 7: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
