CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2006-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE WAIVING OF
PERMIT AND INSPECTION FEES FOR THE INSTALLATION
OF WATER CONSERVATION DEVICES AS A PART OF THE
SOUTH FLORIDA WATER MANAGEMENT DISTRICT'S
WATER SAVINGS INCENTIVE PROGRAM; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the excessive use of water for landscape irrigation accounts for the
greatest waste of water in South Florida's counties and cities; and
WHEREAS, the installation of rain shutoff devices provides an opportunity to
conserve water by reducing the excessive use of water for landscape irrigation; and
WHEREAS, the City of Tamarac received a grant from the South Florida Water
Management District's Water Savings Incentive Program and will use a portion of this grant
to provide rain shutoff devices and installation to water customers; and
WHEREAS, the Water Savings Incentive Program is an annual program providing
water conservation devices, and
WHEREAS, the City of Tamarac shall waive the permit and inspection fees for rain
shutoff devices for program participants within the City; and

WHEREAS, the City of Tamarac shall select participants for the program from
single-family homes, multi -family homes, condominiums, and commercial accounts using
potable water (not well water or lake water); and
WHEREAS, the Directors of Utilities and Building & Code Compliance recommend
that the City of Tamarac waive permit and inspection fees for participants in the rain shutoff
device program; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to waive permit and
inspection fees for participants in the rain shutoff device program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: The City of Tamarac agrees to waive the permit and inspection
fees for the installation of rain shutoff devices installed under the South Florida Water
Management District grant.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: The Resolution shall become effective immediately upon its
passage and adoption.
