R-2006 - 5a'k A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SUBMIT AN APPLICATION TO THE U.S. DEPARTMENT OF HOMELAND SECURITY FOR ASSISTANCE TO FIREFIGHTER GRANT PROGRAM FUNDS FOR REPLACEMENT OF THE FIRE STATION 41 GENERATOR AND FUEL TANK WITH A NEW GENERATOR AND FUEL TANK IN THE AMOUNT OF $100,000 PROVIDING FOR A 20 PERCENT CASH MATCH OF $25,000 IN LOCAL FUNDS FOR A TOTAL PROJECT COST OF $125,000 IN THE EVENT OF APPROVAL OF THE APPLICATION; PROVIDING FOR ACCEPTANCE OF THE AWARD AND EXECUTING OF DOCUMENTS UPON APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to improve emergency management capabilities within the City in the fundamental areas of response and recovery; and WHEREAS, the U. S. Department of Homeland Security provides grants to local governments for modifications to fire stations and facilities through the Assistance to Firefighters Grant Program, and WHEREAS, Tamarac Fire Station #41 is a critical facility and serves as a Field Operations Center during emergencies, and WHEREAS, the City desires to replace the Fire Station #41 generator and upgrade the fuel tank; and 1 Temp Reso. #10937 Page 2 April 11, 2006 WHEREAS, the Fire Station #41 generator and fuel tank are over 25 years old; and WHEREAS, providing for a replacement generator with fuel tank will further enable the City of Tamarac to house essential personnel and equipment, thus ensuring continuity of government services during times of disaster; and WHEREAS, the granting agency requires that, in the event of approval of the application, the City match the 2006 Assistance to Firefighters Grant Program request of $100,000 with a 20 percent cash match in local funds in the amount of $25,000 for a total project cost of $125,000; and WHEREAS, the Assistant City Manager and the Fire Chief recommend approval; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to submit an application to the U.S. Department of Homeland Security for Assistance to Firefighters Grant Program funds for a replacement generator with fuel tank at Fire Station #41. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this resolution. Section 2: The appropriate City Officials are HEREBY authorized to submit an Assistance to Firefighters Grant Program application for a generator and fuel tank in the amount of $100,000 to the U.S. Department of Homeland Security providing for a 20% cash Temp Reso. #10937 Page 3 April 11, 2006 match in local funds of $25,000 for a total project cost of $125,000 in the event of approval of the application. A copy of said application is attached hereto as Exhibit A. Section 3: Upon approval of the application, the appropriate City officials are HEREBY authorized to accept the award and execute the necessary documents following legal review. Section 4: Upon approval of the grant award, the appropriate City Officials are HEREBY authorized to amend the existing Fire Rescue Fund Budget in the amount of $125,000 and appropriate said funds including any and all subsequent budgetary transfers to be in accordance with proper accounting standards. Section 5: All resolutions or parts of resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. Section 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. Will comply with P.L. 93-348 regarding the protection of human subjects involved in research, development, and related activities supported by this award of assistance. 15. Will comply with the Laboratory Animal Welfare Act of 1966 (P.L. 89-544, as amended, 7 U.S.C. 2131 et seq.) pertaining to the care, handling, and treatment of warm blooded animals held for research, teaching, or other activities supported by this award of assistance. 16. Will comply with the Lead -Based Paint Poisoning Prevention Act (42 U.S.C. Section 4801 et seq.) which prohibits the use of lead based paint in construction or rehabilitation of residence structures. 17. Lobbying A. Debarment, Suspension and Other Responsibility Matters (Direct Recipient) A. (e) Notifying the agency, in writing within 10 calendar days after receiving notice under subparagraph (d)(2) from an employee or otherwise receiving actual notice of such conviction. (f) Taking one of the following actions, against such an employee, within 30 calendar days of receiving notice under subparagraph (d)(2), with respect to any employee who is so convicted: (1) Taking appropriate personnel action against such an employee, up to and including termination, consistent with the requirements of the Rehabilitation Act of 1973, as amended; or (2) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health, law enforcement or other appropriate agency.
