A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, OPPOSING THE NORTH
BROWARD HOSPITAL DISTRICT'S CERTIFICATE OF
NEED APPLICATION NO. 9920 FOR A NOVA
SOUTHEASTERN/NORTH BROWARD HOSPITAL
DISTRICT NEW HOSPITAL; DIRECTING THE CITY
CLERK TO SEND A COPY OF THIS RESOLUTION TO
JEFFREY N. GREGG, CHIEF, BUREAU OF HEALTH
FACILITY REGULATION, AGENCY FOR HEALTH CARE
ADMINISTRATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.

WHEREAS, the North Broward Hospital District is a unit of local government,
which has the power to levy ad valorem taxes; and
WHEREAS, the North Broward Hospital District owns and operates several
hospitals and health facilities in Broward County; and
WHEREAS, Nova Southeastern University engages in the business of
providing private university -level education to its students; and
WHEREAS, in pursuit of a cooperative business venture with Nova
Southeastern University, the North Broward Hospital District is proposing to
construct a 144—bed full service community hospital within the Nova Southeastern
University campus(Nova/District Hospital); and
I WHEREAS, the North Broward Hospital District has submitted Certificate of
Need (CON) Application No. 9920 to the State of Florida Agency for Health Care
Administration for the proposed Nova/District Hospital; and

WHEREAS, there are three (3) full service hospitals within six (6) miles of the '
location of the proposed Nova/District Hospital; Plantation General Hospital,
Westside Regional Medical Center and Memorial Pembroke; and Memorial Hospital
West, remains just outside this radius (existing hospitals); and
WHEREAS, there are a total of ten (10) hospitals within a 10-mile radius of
the proposed site and an eleventh hospital just outside of the ten -mile radius; and
WHEREAS, the existing hospitals currently and adequately provide hospital
healthcare services within an extended market area in west Broward County which
includes the residents of Tamarac; and
WHEREAS, the existing hospitals have indicated that, if approved, the
Nova/District Hospital would result in unnecessary duplication of acute care hospital
service, with the consequences of adverse financial impact to both of the existing '
hospitals and staffing problems at the existing hospitals due to the limited labor pool
for skilled nurses; and
WHEREAS, the State of Florida Agency for Health Care Administration has
previously recognized that there is no need for the proposed Nova/District Hospital,
having denied North Broward Hospital District's first CON application (CON
Application No. 9839) for the proposed Nova/District Hospital; and
WHEREAS, the City of Tamarac supports the existing hospitals in their
continuing good efforts to serve the current healthcare needs of the citizens of
Tamarac and the citizens of west Broward County; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to
be in the best interest of the citizens and residents of the City of Tamarac to '
oppose the North Broward Hospital District's Certificate of Need

' Application No. 9920 for a Nova Southeaster/North Broward Hospital District new
hospital and requests that the State of Florida Agency for Health Care
Administration scrutinize North Broward Hospital District's request and carefully
consider the effects of resource oversupply caused by approval of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: The City of Tamarac HEREBY opposes the North
Broward Hospital District's Certificate of Need Application No. 9920 for a Nova
' Southeastern/North Broward Hospital District new hospital and requests that the
State of Florida Agency for Health Care Administration scrutinize North Broward
Hospital District's CON Application No. 9920 and carefully consider the effects of
resource oversupply. The City of Tamarac respectfully requests that the Agency
for Health Care Administration render a decision denying North Broward Hospital
District's CON Application No. 9920.
SECTION 3: The City Clerk is hereby directed to send a certified copy of this
resolution to Jeffrey N. Gregg, Chief, Bureau of Health Facility Regulation, Agency
for Health Care Administration, 2727 Mahan Drive, Bldg. 1, Tallahassee, Florida
32308.
' SECTION 4: All resolutions or parts of resolutions in conflict herewith
are hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
SECTION 6: This Resolution shall become effective immediately
upon its passage and adoption.
