R-2006--k�j A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE AN OCCUPATIONAL LICENSE FEE REFUND IN AN AMOUNT NOT TO EXCEED $1,418.18, TO BE ISSUED TO THE SAINT MALACHY CATHOLIC CHURCH LOCATED AT 6200 JOHN HORAN TERRACE, FOR THE OPERATION OF THE SAINT MALACHY ANNUAL CARNIVAL CONDUCTED ON THURSDAY, OCTOBER 20, 2005 THROUGH SUNDAY, OCTOBER 23, 2005 (CASE NO.3-MI- 06); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on June 1, 2005, the City of Tamarac received a request from the Saint Malachy Parish requesting a waiver of license and/or permit fees to conduct their Annual Carnival beginning Thursday, October 20, 2005 and ending Sunday, October 23, 2005 on church property located at 6200 John Horan Terrace (attached hereto as Exhibit "'I"); and WHEREAS, Saint Malachy Parish conducted their annual carnival to benefit the Saint Malachy Catholic Church, Saint Malachy Catholic School and other worthy causes on Thursday, October 20, 2005 through Sunday, October 23, 2005; and WHEREAS, the Director of Community Development recommends approval of the Occupational License fee refund; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the Temp Reso #10920 — March 14, 2006 Page 2 appropriate City Officials to approve an Occupational License Fee Refund in an amount not to exceed $1,418.18, to be issued to the Saint Malachy Catholic Church located at 6200 John Horan Terrace, for the operation of the Saint Malachy Annual Carnival conducted on Thursday, October 20, 2005 through Sunday, October 23, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby authorizes the appropriate City Officials to approve an Occupational License Fee Refund in an amount not to exceed $1,418.18 (attached hereto as Exhibit "2"), to be issued to the Saint Malachy Catholic Church located at 6200 John Horan Terrace, for the operation of the Saint Malachy Annual Carnival conducted on Thursday, October 20, 2005 through Sunday, October 23, 2005. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 1 1 Temp Reso #10920 — March 14, 2006 Page 3 SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. University Dr. in Tamarac. We have a new carnival company, Midwest Midways, who will be providing the rides. We would like to request permission to sell/serve alcoholic beverages at this event.
