RESOLUTION NO. R-2006--L4
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE CHANGE ORDER NUMBER 1 TO THE
AGREEMENT BETWEEN THE CITY OF TAMARAC AND TENEX
ENTERPRISES, INC. FOR THE CONSTRUCTION OF ADDITIONAL
PARKING AREA AT NORTHWEST END OF SOUTHGATE BLVD.
STREETSCAPE IMPROVEMENT PROJECT; AUTHORIZING AN
ADDITIONAL EXPENDITURE IN AN AMOUNT NOT TO EXCEED
$54,361.95 FOR SAID PURPOSE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on December 14, 2005 the City Commission approved the award of Bid
No. 05-19B to Tenex Enterprises, Inc. for the Southgate Blvd. Streetscape Improvement
Project through Resolution R-2005-236, a copy of said Resolution attached hereto as
Exhibit 1; and
WHEREAS, the construction of Southgate Linear Park will be adjacent to the
Southgate Blvd. Streetscape Improvement Project from Nob Hill Road West to the end of
the road; and
WHEREAS, in order to accommodate the future Southgate Linear Park visitors, an
additional parking area is requested to be constructed at the northwest end of Southgate
Blvd. Streetscape Improvement Project. The additional parking area is including one (1)
handicapped parking stall, twenty-five (25) regular parking stalls and associated
landscaping and irrigation work; and
WHEREAS, Tenex Enterprises, Inc. submitted a proposal for this additional parking
area, a copy of said proposal attached hereto as Exhibit 2; and

WHEREAS, Public Works staff has reviewed said proposal and has determined that
the pricing is competitive and acceptable; and
WHEREAS, the cost of this change order necessitates an additional expenditure in
an amount not to exceed $54,361.95, a copy of Change Order No. 1 attached hereto as
Exhibit 3; and
WHEREAS, funding for this Change Order is available in the Project Contingency
Allowance; and
WHEREAS, the Director of Public Works and Purchase/Contracts Manager
recommend the authorization of Change Order No. 1 to the Southgate Blvd. Streetscape
Improvement Project in an amount not to exceed $54,361.95; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the Citizens and residents of the City of Tamarac to approve Change
Order No. 1 to the Southgate Blvd. Streetscape Improvement Project and authorize an
additional expenditure in an amount not to exceed $54,361.95 for said purpose
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution upon adoption hereof.
SECTION 2: The appropriate City Officials are HEREBY AUTHORIZED to
execute Change Order No. 1 to the contract with Tenex Enterprises, Inc. for the
construction of additional parking area at the northwest end of the project.
SECTION 3: An additional expenditure in an amount not to exceed
$54,361.95 for this purpose is HEREBY approved.

SECTION 4: All Resolutions or parts of Resolutions in conflict herewith
are HEREBY repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not effect other provisions
or application, and to this end the provisions of this resolution are declared to be
severable.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO AWARD BID NUMBER
05-19B TO TENEX ENTERPRISES, INC. AND EXECUTE A
CONTRACT WITH TENEX ENTERPRISES, INC., THE MOST
RESPONSIVE AND RESPONSIBLE BIDDER FOR AN
AMOUNT OF $1,239.469.26 FOR THE SOUTHGATE
BOULEVARD STREETSCAPE IMPROVEMENT PROJECT,
AUTHORIZING THE CITY MANAGER TO MAKE
NECESSARY ADDITIONS, DELETIONS OR REVISIONS TO
THE WORK PLAN PURSUANT TO SECTION 6-156 OF THE
CODE OF THE CITY OF TAMARAC, FLORIDA;
AUTHORIZING BUDGETARY TRANSFERS AS NECESSARY
FOR PROPER ACCOUNTING PURPOSES; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVITE DATE.
WHEREAS, on July 22, 1998, the City Commission of the City of Tamarac approved
the Seven Year Comprehensive Street Improvement Program through the approval of
Resolution No. R98-227; and
WHEREAS, five (5) phases of this Program, totaling approximately 121 miles of
City streets have been completed; and
WHEREAS, the Southgate Boulevard Streetscape Improvement Project as part of
this Program is being proposed; and
WHEREAS, the City of Tamarac publicly advertised Bid No. 05-19B Southgate
Boulevard Streetscape Improvement Project (see Exhibit #1), a continuance of the Seven
Year Comprehensive Street Improvement Program in the Sun -Sentinel on August 28 h and
September 4"', 2005, and

WHEREAS, September 28, 2005, four (4) bids were opened and reviewed in order
to determine cost and responsiveness to the City's technical specifications; and
WHEREAS, Tenex Enterprises, Inc. provided the most responsive and responsible
bid for the Southgate Boulevard Streetscape Improvement Project, a continuance of the
Seven Year Comprehensive Street Improvement Program, a copy of the bid tabulation
(Exhibit #3) and Bid (Exhibit #2) are hereto attached; and
WHEREAS, available funds exist in the Seven Year Comprehensive Street
Improvement Program and Stormwater Capital Improvement budget for the aforesaid
purpose; and
WHEREAS, the Director of Public Works and Purchasing and Contracts Manager
recommend that the City award Bid No. 05-19B to and authorize appropriate City officials
to execute agreement (Exhibit #4) with Tenex Enterprises, Inc. for the Southgate
Boulevard Streetscape Improvement Project, a continuance of the Seven Year
Comprehensive Street Improvement Program in the amount of $1,239,469.26; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to award Bid #05-19B
to Tenex Enterprises, Inc. for the Southgate Boulevard Streetscape Improvement Project,
a continuance of the Seven Year Comprehensive Street Improvement Program and
authorize an expenditure in an amount not to exceed $1,239,469.26.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:

SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The award of Bid No. 05-19B for the Southgate Boulevard
Streetscape Improvement Project, a continuance of the Seven Year Comprehensive Street
Improvement Program to Tenex Enterprises, Inc. is hereby approved.
SECTION 3: The appropriate City Officials are authorized to execute the
Agreement between the City of Tamarac and Tenex Enterprises, Inc. for the Southgate
Boulevard Streetscape Improvement Project, a continuance of the Seven Year
Comprehensive Street Improvement Program, a copy being hereto attached as Exhibit 4.
SECTION 4: An expenditure in an amount not to exceed $1,239,469.26 is
hereby authorized to Tenex Enterprises, Inc.
SECTIQN 5: The Resolution authorizes necessary budget transfer to
accommodate this action.
SECTION 6: The City Manager is hereby authorized to make additions,
deletions or revisions to the Seven Year Comprehensive Street Improvement Program
pursuant to Section 6-156 of the Code of the City of Tamarac.
SECTION 7: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 8: If any provision of this Resolution or the application thereof to
