RESOLUTION NO. R-2004- 13
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
A PARKING WAIVER OF FIVE (5) PARKING
SPACES TO REDUCE THE NUMBER OF
REQUIRED PARKING SPACES FROM TWENTY-
ONE (21) TO SIXTEEN (16) PARKING SPACES
FOR THE LAUDERDALE LAKES SEVENTH DAY
ADVENTIST CHURCH, LOCATED AT 3701
WEST COMMERCIAL BOULEVARD,
SPECIFICALLY THE SOUTH 45.00 FEET OF
LOT 17, AND LOTS 18 AND 19 LESS THE
SOUTH 10.00 FEET OF THE "TAMARAC
BUSINESS CENTER" PLAT, ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT
BOOK 61, PAGE 27 OF THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA (CASE NO.
10-Z-04); PROVIDING FOR CONDITIONS OF
APPROVAL; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that
the City Commission may grant a limited waiver of the off street parking and loading
requirements whenever a hardship would exist by adhering to strict application thereof, and
further provides that the waiver would not be detrimental to public safety, health and
welfare of the citizens of the City; and
WHEREAS, Lauderdale Lakes Seventh Day Adventist Church desires to operate a
non-profit church for parishioners; and
WHEREAS, adhering to the twenty-one (21) parking spaces required by the City of
Tamarac Code of Ordinances would create a deficit of five (5) parking spaces for

prospective parishioners of the church when only sixteen (16) spaces exist on site; and
WHEREAS, a hardship exists for Lauderdale Lakes Seventh Day Adventist Church
if the Parking Waiver of five (5) spaces is not granted, as they are leasing the building and
cannot make physical changes, and furthermore, cannot accommodate additional parking
spaces; and
WHEREAS, Lauderdale Lakes Seventh Day Adventist Church has filed an
application for a Parking Waiver of five(5) required parking spaces to reduce the number of
required parking spaces from twenty-one (21) to sixteen (16) parking spaces; and
WHEREAS, the Planning Board held a public hearing on May 19, 2004 , thereon
and recommended approval of this application; and
WHEREAS, the Director of Community Development has thoroughly reviewed and
recommends approval of this application; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant a parking
waiver of five (5) spaces to reduce the number of required parking spaces from twenty-one
(21) to sixteen (16) parking spaces for the Lauderdale Lakes Seventh Day Adventist
Church, located at 3701 West Commercial Boulevard, specifically the South 45.00 feet of
Lot 17, and Lots 18 and 19 Less the South 10.00 feet of the "Tamarac Business Center"
Plat, according to the Plat thereof as recorded in Plat Book 61, Page 27 of the Public
Records of Broward County, Florida.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the application by the Lauderdale Lakes Seventh Day
Adventist Church requesting a parking waiver of five (5) spaces to reduce the number of
required parking spaces from twenty-one (21) to sixteen (16) parking spaces, located at
3701 West Commercial Boulevard, is HEREBY APPROVED, subject to the following
condition:
a) This Parking Waiver shall become null and void for 3701 West
Commercial Boulevard upon vacation of the building by Lauderdale
Lakes Seventh Day Adventist Church.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

This Resolution shall become effective immediately upon its
