R-2004-J53 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING TERMS OF EMPLOYMENT OF THE CITY ATTORNEY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Attorney is a charter officer of the City of Tamarac working directly for the City Commission; and and WHEREAS, Mitchell S. Kraft has been employed as City Attorney since February 18, 1992; WHEREAS, the City Commission has determined that an adjustment of the terms of employment is appropriate at this time; and WHEREAS, available funds exist in the General Fund Budget for said purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Attorney's salary, effective October 1, 2004 shall be increased by five percent (5%) per annum. SECTION 3: The City increases its contribution to the City Attorney's 401(a) plan by an additional two percent (2%) of his pay per annum effective October 1, 2004. Temp. Reso #10474 June 8, 2004 Page 2 SECTION 4: The City increases its contribution to the City Attorney's deferred compensation plan in the amount of $4,000 per year with the total amount of deferred compensation to be paid annually in a lump sum every calendar year on or before January 10. SECTION 5: All necessary budget transfers are hereby approved. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 8: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 23rd day of June, 2004.
