R-2004- 16 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA IN SUPPORT OF THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION'S OPPOSITION TO THE WIDENING OF THE SAWGRASS EXPRESSWAY FROM ATLANTIC BOULEVARD TO THE TURNPIKE MAINLINE, AND THE FLORIDA TURNPIKE FROM GRIFFIN ROAD TO ATLANTIC BOULEVARD UNLESS NECESSARY NOISE ABATEMENT MEASURES ARE IMPLEMENTED TO PROTECT THE RESIDENTS ADJACENT TO THE PROJECT; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PROVIDE COPIES OF THIS RESOLUTION TO THE FLORIDA DEPARTMENT OF TRANSPORTATION, THE FLORIDA DEPARTMENT OF TRANSPORTATION'S FLORIDA TURNPIKE ENTERPRISE, AND THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Transportation's Florida Turnpike Enterprise is concurrently concluding a Project Development and Environment Study and preliminary design far the widening of the Sawgrass Expressway from Atlantic Boulevard to the Turnpike Mainline and the Florida Turnpike from Griffin Road to Atlantic Boulevard; and WHEREAS, the Florida Turnpike Enterprise anticipates widening portions of its facilities to as many as eight lanes plus two auxiliary lanes; and WHEREAS, the Florida Turnpike Enterprise is responsible for evaluation of its projects' social and economical impacts; and WHEREAS, the Florida Turnpike Enterprise is responsible for informing and involving interested parties in the development of transportation projects; and WHEREAS, the Florida Turnpike Enterprise studies fail to recommend noise abatement throughout all of the areas to be widened; and Temp. Reso # 10332 January 16, 2004 Page 2 WHEREAS, the Florida Turnpike Enterprise's policies fail to distinguish between urban and rural densities; and WHEREAS, the Florida Turnpike Enterprise does not intend to fully and adequately abate noise for areas not meeting the "benefited receiver" requirement even though this includes residences directly abutting the expansion area; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to support the Broward County Metropolitan Planning Organization's opposition to the widening of the Sawgrass Expressway from Atlantic Boulevard to the Turnpike Mainline and the Florida Turnpike from Griffin Road to Atlantic Boulevard unless noise is adequately abated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac supports the Broward County Metropolitan Planning Organization's opposition to the widening of the Sawgrass Expressway from Atlantic Boulevard to the Turnpike Mainline and the Florida Turnpike from Griffin Road to Atlantic Boulevard unless necessary noise abatement measures are implemented to protect the residents adjacent to the project. SECTION 3: The appropriate City Officials are hereby authorized to provide copies of this resolution to the Florida Department of Transportation, the Florida Department of Transportation's Florida Turnpike Enterprise, and the Broward County Metropolitan Planning Organization. 1 G Temp. Reso # 10332 January 16, 2004 Page 3 SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 28" day of January, 2004.
