RESOLUTION NO. R-2004- �y'w
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO APPROVE THE SALE OF
ALCOHOLIC BEVERAGES FOR SAINT
MALACHY CATHOLIC CHURCH DURING THE
OPERATION OF THEIR ANNUAL SAINT
MALACHY CARNIVAL BEGINNING THURSDAY,
SEPTEMBER 23, 2004 AND ENDING SUNDAY,
SEPTEMBER 26, 2004 (CASE NO. 17-MI-04);
PROVIDING FOR CONDITIONS OF APPROVAL;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, St. Malachy Catholic Church is a non-profit organization which annually
conducts a carnival to benefit the St. Malachy Catholic Church, St, Malachy Catholic
School and other worthy causes; and
WHEREAS, the City of Tamarac received a request from Rita Fonteciella, Carnival
Chairperson for the St. Malachy Catholic School (attached hereto as Exhibit "1 "),
requesting permission to sell/serve alcoholic beverages during the operation of the Saint
Malachy Catholic Church Annual Carnival beginning Thursday, September 23, 2004 and
ending Sunday, September 26, 2004; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to approve the sale of alcoholic beverages for Saint Malachy

Catholic Church during the operation of their annual Saint Malachy Carnival beginning
Thursday, September 23, 2004 and ending Sunday, September 26, 2004.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission of the City of Tamarac HEREBY
APPROVES the sale of alcoholic beverages for Saint Malachy Catholic Church during the
operation of their annual Saint Malachy Carnival beginning Thursday, September 23, 2004
and ending Sunday, September 26, 2004 subject to the following conditions:
1. That the selling of alcoholic beverages is subject to regulations of the State
of Florida Department of Regulations, Division of Alcoholic Beverages and
Tobacco.
2. That the sale of alcoholic beverages shall take place during the operation of
the Saint Malachy Catholic Church Annual Carnival event beginning
Thursday, September 23, 2004 through Sunday, September 26.2004.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

To Whom it May Concern-.
We will be having our annual carnival at St. Malachy Catholic Church on
September 23rd, 24th, 25th, and 26th. As usual, this will take place on
our parish grounds (6200 N. University Drive). We would like to request
pennission to sell/serve alcoholic beverages at this event. In addition, we
are requesting a waiver of license and/or pen -nit fees as they have in the
past.
