CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2004-
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ACCEPT A
DONATION FROM PAUL YELIN TO FUND THE
PURCHASE OF A SCULPTURE FROM ARTIST
LEONARDO NIERMAN AS PART OF THE CITY'S
PUBLIC ART PROGRAM; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, through the adoption of Ordinance No. 0-2004-15, the City of Tamarac
established a Public Art Program; and
WHEREAS, a Public Art Program helps to create a stronger sense of community
identity and can expand the opportunity for residents and visitors to the City to encounter a
variety of cultural experiences; and
WHEREAS, the City's Public Art Program is designed to contribute to and enhance
community identity and pride, reflect the community's values and culture, provide the
highest quality of art available, promote excellence and diversity through a variety of artists
and media, encourage public participation and interaction with public spaces, and increase
awareness of how surroundings impact experience, among other benefits; and
WHEREAS, a Tamarac resident, Paul Yelin, wishes to donate $140,000.00 for the
purchase of a sculpture created by artist Leonardo Nierman to be placed in front of the
Tamarac Community Center; and

WHEREAS, the City of Tamarac agrees to accept a donation from Paul Yelin in the
amount of $140,000.00 for the purchase of a sculpture created by artist Leonardo Nierman
to be placed in front of the Tamarac Community Center; and
WHEREAS, the Parks and Recreation Director and City Manager recommend that
the City of Tamarac accept a donation from Paul Yelin in the amount of $140,000.00 for
the purchase of a sculpture created by artist Leonardo Nierman to be placed in front of the
Tamarac Community Center; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to accept a donation
from Paul Yelin in the amount of $140,000.00 for the purchase of a sculpture created by
artist Leonardo Nierman to be placed in front of the Tamarac Community Center.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The City of Tamarac accepts a donation of $140,000.00 from Paul
Yelin for the purchase of a sculpture created by artist Leonardo Nierman to be placed in
front of the Tamarac Community Center.

SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon adoption.
PASSED, ADOPTED AND APPROVED this 8th day of September, 2004.
