R-2004-o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO DESIGNATE SANDERS COMPANY, INC. AS A SOLE SOURCE PROVIDER FOR PUMPS AND APPURTENANCES UTILIZED AT 20 CITY WASTEWATER PUMP STATIONS, AND TO AUTHORIZE EXPENDITURES FOR THE PURCHASE OF PUMPS AND APPURTENANCES FROM SANDERS COMPANY, INC., FOR AN AMOUNT NOT TO EXCEED $55,000.00 FOR THE PERIOD OF NOVEMBER 1, 2004 THROUGH SEPTEMBER 30, 2005; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City operates and maintains 76 wastewater pump stations; and WHEREAS, 20 of the 76 pump stations utilize installed pumps and appurtenances manufactured by Smith & Loveless, Inc.; and WHEREAS, Smith & Loveless, Inc., manufactured the pumps originally installed at these stations; and WHEREAS, Smith & Loveless, Inc., does not sell pumps directly to end -users, and has chosen to appoint Sanders Company, Inc., as their sole regional South Florida distributor for pumps and appurtenances manufactured by their firm (a copy of which is attached hereto as "Exhibit 1"); and Temp. Reso. #10582 October 20, 2004 Page 2 Revision 1, November 10, 2004 WHEREAS, the compatibility of pumps and appurtenances is necessary due to unique physical constraints within the wastewater pump stations, requiring the use of specialized equipment only available through Sanders Company, Inc., the regional distributor for Smith & Loveless, Inc.; and WHEREAS, the purchase of pumps from other manufacturers would require the City to perform expensive renovations of these pump stations; and WHEREAS, standardization of pump equipment is desirable in order to maintain continuity of replacement parts; and WHEREAS, Sanders Company, Inc., is the sole regional supplier of compatible equipment that matches the original Smith & Loveless, Inc., pump equipment and meets the City's specifications for above -grade wastewater pump stations; and WHEREAS, the Director of Utilities and the Purchasing and Contracts Manager have chosen to designate Sanders Company, Inc., as a sole source provider, as provided under City Code 6-151; and WHEREAS, available funds exist in the appropriate Utilities capital and operating budget for said purpose; and WHEREAS, the Director of Utilities and the Purchasing and Contracts Manager recommend the designation of Sanders Company, Inc., as a sole source provider, and recommend approval of the expenditure of funds to purchase pumps and appurtenances from Sanders Company, Inc., in an amount not to exceed $55,000.00; and 1 Temp. Reso. #10582 October 20, 2004 Page 3 Revision 1, November 10, 2004 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to designate Sanders Company, Inc., as a sole source provider for pumps and appurtenances utilized at 20 wastewater pump stations, and to authorize expenditures for the purchase of pumps and appurtenances from Sanders Company, Inc., in an amount not to exceed $55,000.00 for the period of November 1, 2004 through September 30, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: Sanders Company, Inc., is designated as the sole source provider for pumps and appurtenances utilized at 20 pumping stations and the appropriate City Officials are hereby authorized to purchase pumps and appurtenances from Sanders Company, Inc., in an amount not to exceed $55,000.00 for the period of November 1, 2004 through September 30, 2005. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: passage and adoption. Temp.
