R-2004- a"1 LA A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A SPECIAL EXCEPTION TO ALLOW THE CONSTRUCTION OF MORE THAN ONE (1) PRINCIPAL BUILDING ON THE SUBJECT PROPERTY IN AN R-3 (LOW -DENSITY MULTI- FAMILY RESIDENTIAL DISTRICT) ZONING CATEGORY TO SANTA MONICA, LOCATED AT THE SOUTH SIDE OF SOUTHGATE BOULEVARD, NEAR THE SAWGRASS EXPRESSWAY, SPECIFICALLY A PARCEL OF LAND LYING IN SECTION 6, TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS: COMMENCE AT THE POINT OF INTERSECTION OF THE SOUTH RIGHT-OF- WAY LINE OF CANAL C-14 OF CENTRAL AND SOUTHERN FLORIDA FLOOD CONTROL DISTRICT AND THE WEST LINE OF SAID SECTION 6: THENCE EASTERLY ALONG THE SAID SOUTH RIGHT-OF-WAY LINE OF CANAL C-14, 1200 FEET TO A POINT; THENCE SOUTHERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE, 286 FEET TO A POINT OF BEGINNING OF THE DESCRIPTION; THENCE CONTINUE SOUTHERLY, ALONG THE LAST DESCRIBED LINE, 435 FEET TO A POINT; THENCE EASTERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE 435 FEET TO A POINT; THENCE WESTERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE, 400 FEET TO THE POINT OF BEGINNING (CASE NO. 22-Z- 04); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of the City of Tamarac provides for the granting of a special Temp Reso #10591 — November 18, 2004 Page 2 1 exception to allow the construction of more than one (1) principal building on the subject property in an R-3 (Low -Density Multi -Family Residential District) zoning category to Santa Monica located at the south side of Southgate Boulevard, near the Sawgrass Expressway, specifically a parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described as: commence at the Point of Intersection of the South right-of-way line of Canal C-14 of Central and Southern Florida Flood Control District and the West line of said Section 6: thence Easterly along the said South right-of-way line of Canal C-14, 1200 feet to a point; thence Southerly, perpendicular to the last described fine, 286 feet to a Point of Beginning of the description; thence continue Southerly, along the last described line, 435 feet to a point; thence Easterly, perpendicular to the last described line 435 feet to a point; thence Westerly, perpendicular to the last described line, 400 feet to the Point of Beginning; and WHEREAS, the Planning Board held a public hearing on November 17, 2004 and recommended approval; and WHEREAS, the Director of Community Development recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac finds that granting the petition for special exception would be in keeping with the public health, safety and general welfare of the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant this special exception to allow the construction of more than one (1) principal building on the subject u Temp Reso #10591 — November 18, 2004 Page 3 property in an R-3 (Low -Density Multi -Family Residential District) zoning category to Santa Monica located at the south side of Southgate Boulevard, near the Sawgrass Expressway, specifically a parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described as: commence at the Point of Intersection of the South right-of-way line of Canal C-14 of Central and Southern Florida Flood Control District and the West line of said Section 6: thence Easterly along the said South right-of-way line of Canal C-14, 1200 feet to a point; thence Southerly, perpendicular to the last described line, 286 feet to a Point of Beginning of the description; thence continue Southerly, along the last described line, 435 feet to a point; thence Easterly, perpendicular to the last described line 435 feet to a point; thence Westerly, perpendicular to the last described line, 400 feet to the Point of Beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the Petition for special exception to allow the construction of more than one (1) principal building in an R-3 (Low -Density Multi -Family Residential District) zoning category to Santa Monica located at the south side of Southgate Temp Reso #10591 — November 18, 2004 Page 4 Boulevard, near the Sawgrass Expressway, specifically a parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described as: commence at the Point of Intersection of the South right-of-way line of Canal C-14 of Central and Southern Florida Flood Control District and the West line of said Section 6: thence Easterly along the said South right-of-way line of Canal C-14, 1200 feet to a point; thence Southerly, perpendicular to the last described line, 286 feet to a Point of Beginning of the description; thence continue Southerly, along the last described line, 435 feet to a point; thence Easterly, perpendicular to the last described line 435 feet to a point; thence Westerly, perpendicular to the last described line, 400 feet to the Point of Beginning; is HEREBY APPROVED. SECTION 3: Conditions of approval: 1. The applicant shall be required to pay all appropriate fees associated with the special exception. 2. The special exception is transferable administratively pursuant to compliance with City Codes, submitting documentation and payment of fees. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.
