R- 2004- w A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SEEK HIGHWAY SAFETY GRANT FUNDING FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION IN AN AMOUNT NOT TO EXCEED $35,000 FOR A CHILD SAFETY SEAT PROGRAM PROVIDING FOR A CITY MATCH IN KIND; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to improve motor vehicle passenger safety within the City; and WHEREAS, the Federal Government has made funds available to the State to for projects related to traffic safety; and WHEREAS, the Florida Department of Transportation via the Highway Safety Grant program sub -grants these Federal dollars to municipalities for traffic safety priority areas; and WHEREAS, the City Commission of the City of Tamarac wishes to provide for distribution of child passenger safety seats and provide education relative to the proper use and installation of child passenger safety seats through submission of an application for a Highway Safety Grant, a copy of which is hereto attached as Exhibit A; and Temporary Reso. 10379 Page 2 — March 17, 2004 WHEREAS, the City Manager and the Fire Chief, recommend approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to seek Highway Safety Grant funds through the Florida Department of Transportation in order to provide a child passenger safety program. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The appropriate City staff and City Officials are hereby authorized to seek grant funding from the Florida Department of Transportation Highway Safety Grant Program in an amount not to exceed $35,000 and to provide a City match in kind to provide a Child Safety Seat Program. Section 3: All resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. Twenty nine percent of the crashes studied were judged potentially survivable. While it was unclear why these children did not survive, 12% were dtermined to have been placed in safety seats which were improperly secured. Today's vehicles are designed to provide safe seating for adults via front and rear seat belts, and many are equipped with driver and front passenge air bags. But to make vehicles safe for infants and children. it's necessary to provide specially designed child safety seats, to install them correctly and in the right location, and to use them without fail when on the move. (You may also see these devices referred to as "child safety restraints," "car seats," or "child restraint systems.) The Problem: I . Many children are incorrectly placed in Safety Seats. 2. Many Safety Seats are incorrectly installed into vehicles. 3. Increasingly many families cannot afford to purchase the correct seats and therefore children are not properly restrained, or if a child restrained is provided, it is not the correct restraint for the specific child. 4. Many seats are incorrectly placed in the vehicle making the child more succeptable to injury in an accident. Much of the problem is attributable to a lack of education. Hospitals require a safety seat be used when removing a newborn from their facility, but lack the personnel to actually install, instruct parents on proper seat installation and use or even check for safety of the seat. The majority of of the title the hospitals staff will direct new parents to Fire Rescue or Law Enforcement agencies for instruction on proper use Local safety seat vendors will be more then happy to sell seats to purchasers but due to the liability they do not provide installation in most cases, again they are directed to Fire Rescue or Law Proposed Solution: Tamarac Fire Rescue Proposes to provide a Child Safety Seats Program, to make scats, information and instruction on proper use available to all residents in Tamarac the surrounding area. This will be done by taking the program to the community rather than solely tasking the community with coming to use. The City proposes to secure and equip a trailer with the materials needed to provide a comprehensive program. This will criable the City to go to areas where people may not be able to come to us. We would also plan to assist other municipalities throughout Broward with their safety seat inspection programs. In addition, print materials would be made available to anyone requesting them and provided to residents who may be stoped on a traffic stops. Print materials would be placed on all Fire Apparatus and made available to the City's local law enforcement. Tamarac Fire Rescue Nvould schedule fiting stations quarterly and be available for community special events year round. Tamarac Fire Rescue will plan to Provide one Event per childcare facility in Tamarac a year, in addition to the above. Proposed Solution: (Continued) This service will also be made available at anytime with an appointment. All seats and Inspections will be done by certified inspectors. Objectives: Safety Seat Program: To correctly fit or replace any childs seat that is either damaged or the incorrect size for the subject child. We will do this by on sight inspections and by education. we would expect to increase child safety seat use by a minimum of' 10%, .
