RESOLUTION NO. R-2004-'70
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE CHANGE
ORDER NUMBER 1 TO THE SEVEN YEAR
COMPREHENSIVE STREET IMPROVEMENT PROGRAM
PHASE IV-B CONTRACT WITH VILA & SON LANDSCAPING,
INC. FOR THE ADDITION OF GREENBRIAR MEDIAN
BEAUTIFICATION, THE SUBSTITUTION OF DWARF FIRE
BUSH FOR DWARF FAKAHATCHEE GRASS THROUGHOUT
THE PROJECT AND THE COST OF MODIFYING THE
FITTINGS USED WITH MAINLINE IRRIGATION PIPES;
AUTHORIZING AN ADDITIONAL EXPENDITURE IN AN
AMOUNT NOT TO EXCEED $101,038.11; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 9, 2003 the City Commission approved the award of Invitation
For Bid No. 02-28B to Vila & Son Landscaping, Inc. for Median Beautification under
Phase IV-B of the Street Improvement Program through Resolution R-2003-79, a copy of
said Resolution attached hereto as Exhibit 1; and
WHEREAS, the scope of work for Phase IV-B included the beautification of
approximately 18 miles of street medians, including NW 75th Street medians from NW 88th
Avenue to NW 801h Avenue; and
WHEREAS, it is desirable to add '/ mile of median beautification on NW 75th Street
from NW 75th Avenue to NW 73Id Terrace in the Greenbriar Subdivision to the original
scope of work to be performed by Vila & Son Landscaping Inc.; and
WHEREAS, the original scope of work included the installation of Dwarf
Fakahatchee Grass be installed throughout the project; and

WHEREAS, the use of Dwarf Fakahatchee Grass has been determined to constitute
a potential sight hazard within the medians; and
WHEREAS, it has been determined by the Public Works Department that Dwarf Fire
Bush is an acceptable substitute for Dwarf Fakahatchee Grass; and
WHEREAS, Wayne Kiser and Associates, P.A., the Architect of Record for the
design of the irrigation system within Phase IV-B, is requiring the use of Schedule 80
fittings for all irrigation mains smaller than 6" diameter and requiring ductile iron fittings for
all 6" irrigation mains; and
WHEREAS, Public Works staff has reviewed said changes and have determined
that the pricing is competitive and acceptable; and
WHEREAS, the cost of additional work attributed to this change order necessitates
an additional expenditure in an amount not to exceed $101,038.11 from the Road
Resurfacing Program Budget, a copy of Change Order No. 1 attached hereto as Exhibit 2;

WHEREAS, the Director of Public Works and the Purchasing and Contracts
Manager recommend the authorization of Change Order No. 1 to the Street Improvement
Program Phase IV-B Project in an amount not to exceed $101,038.11; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve Change
Order No. 1 to the Street Improvement Program Phase IV-B Project with Vila & Son
Landscaping Inc. for the addition of Greenbriar Median Beautification, the substitution of
Dwarf Fire Bush for Dwarf Fakahatchee Grass throughout the Project and the cost of
modifying the fittings used with mainline irrigation pipes and authorize an additional
expenditure in an amount not to exceed $101,038.11 for said purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution upon adoption hereof.
SECTION 2: The appropriate City Officials are HEREBY AUTHORIZED to
execute Change Order No. 1 to the contract with Vila & Son Landscaping, Inc. for the
addition of Greenbriar Median Beautification, the substitution of Dwarf Fire Bush for Dwarf
Fakahatchee Grass throughout the project and the cost of modifying the fittings used with
mainline irrigation pipes.
SECTION 3: An additional expenditure in an amount not to exceed
$101,038.11 for these purposes is HEREBY approved.

SECTION 4: All Resolutions or parts of Resolutions in conflict herewith
are HEREBY repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not effect other provisions
or application, and to this end the provisions of this resolution are declared to be
severable.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

FOR MEDIAN BEAUTIFICATION UNDER PHASE IV-B OF
THE SEVEN YEAR COMPREHENSIVE STREET
IMPROVEMENT PROGRAM; AWARDING BID NO. 02-28B
TO VILA AND SON LANDSCAPING CORPORATION;
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE AN AGREEMENT WITH VILA & SON
LANDSCAPING CORPORATION; AUTHORIZING AN
EXPENDITURE IN AN AMOUNT NOT TO EXCEED
$3,424,626.61, WHICH REPRESENTS A CONTRACT
AWARD OF $3,113,296.92 AND A PROJECT
CONTINGENCY OF $311,329.69; AUTHORIZING THE CITY
TO MAKE NECESSARY ADDITIONS, DELETIONS, OR
REVISIONS TO THE PHASE IV-B WORKPLAN PURSUANT
TO SECTION 6-156 OF THE CODE OF THE CITY OF
TAMARAC, FLORIDA; AUTHORIZING BUDGETARY
TRANSFERS AS NECESSARY FOR PROPER ACCOUNTING
PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on July 22, 1998, the City Commission of the City of Tamarac approved
the Seven Year Comprehensive Street Improvement Program through the approval of
Resolution No. R98-227; and
WHEREAS, Phase I through III, encompassing approximately 101 miles of City
streets have been completed; and
WHEREAS, Phase IV -A is in progress and includes the rehabilitation of
approximately 23 miles of roadway; and
WHEREAS, Phase IV-B consists of the median beautification of approximately 18
miles of median as part of this program, a copy of which is attached hereto as Exhibit 1;

WHEREAS, the City of Tamarac publicly advertised Bid No. 02-288 for median
beautification under Phase IV-B in the Sun -Sentinel on November 3', 10ti'and 17`", 2002,
hereto attached as Exhibit 2; and
WHEREAS, on January 15, 2003, the following three (3) bids were opened and
reviewed to determine cost and responsiveness to the City's specifications:

WHEREAS, based on the bid results, it was determined that Vila& Son Landscaping
Corporation submitted the lowest responsive and responsible bid proposal, attached hereto
as Exhibit 3; and
WHEREAS, it is recommended that expenditures in an amount not to exceed
$3,424,626.61 be authorized based on Vila & Son Landscaping Corporation's submitted
bid price of $3,113,296.92 and a construction contingency of $311,329.69 to account for
fluctuations in material prices, variance in quantities and unforeseen field conditions; and
WHEREAS, available funds exist in the Street Improvement Program budget for said
purpose; and
WHEREAS, Vila & Son Landscaping Corporation, as the lowest responsible bidder,
has re -reviewed the project scope of work and agrees the price submitted was as intended,
as evidenced in Exhibit 4; and

WHEREAS, Glatting, Jackson, Kersher, Anglin, Lopez and Rinehart, Inc., as the
provider of landscape architectural and engineering services for Phase IV-B, has reviewed
the submitted bids, and agrees to the award of contract to Vila & Son Landscaping
Corporation, as evidenced in Exhibit 5; and
WHEREAS, it is the recommendation of the Public Works Department and the
Purchasing and Contracts Division that the City award the Bid No. 02-28B and to execute
an agreement with Vila & Son Landscaping Corporation for median beautification in the
amount of $3,113,296.92 for Median Beautification under Phase IV-B of the Seven Year
Comprehensive Street Improvement Program; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interest of the citizens and residents of the City of Tamarac to award Bid No. 02-28B
and to execute an agreement with Vila & Son Landscaping Corporation, in an amount not to
exceed $3,113,296.92 for Median Beautification under Phase IV-B of the Seven Year
Comprehensive Street Improvement Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The list of streets, identified as the Phase IV-6 Median
Beautification Work Plan, and attached as Exhibit 1 is HEREBY APPROVED.
SECTION 3: The appropriate City Officials are hereby authorized to award
Bid No. 02-28B to Vila & Son Landscaping Corporation for median beautification included
in Phase IV-B of the Seven Year Comprehensive Street Improvement Program, and to

close the bid award including but not limited to making final payment and releasing bonds
when work has been satisfactorily completed within the terms and conditions of the
contract.
SECTION 4: The appropriate City Officials are HEREBY AUTHORIZED to
execute an agreement with Vila & Son Landscaping Corporation awarding a contract for
median beautification under the Phase IV-B Work Plan, a copy of said agreement hereto
attached as Exhibit 6.
SECTION 5: A total expenditure in an amount not to exceed $3,424,626.61 is
HEREBY AUTHORIZED, which represents a contract award of $3,113,296.92 to Vila &
Son Landscaping Corporation and a project contingency of $311,329.69.
SECTION 6.: The City is hereby authorized to make necessary additions,
deletions or revisions to the Phase IV-B work plan, pursuant to Section 6-156 of the Code
of the City of Tamarac, Florida.
SECTION 7: Budget transfers which may be required for proper accounting
purposes and financial control are HEREBY AUTHORIZED.
SECTION 8: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 9: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.

work to be performed by Vila & Son Landscaping Inc., as submitted in a proposal for the amount of $55,589.60 (Exhibit

has been determined that the use of Dwarf Fakahatchee Grass constitutes a potential sight hazard within the

Wayne Kiser and Associates, P.A., the Architect of Record for the design of the irrigation system within
Phase IV-B, is requiring the use of Schedule 80 fitting for all irrigation mains smaller than 6" diameter and
requiring ductile iron fittings for all 6" irrigation mains. The additional cost of using irrigation fitting as specified
by the Architect was submitted as a proposal by Vila & Son Landscaping, Inc., totaling $33,681.01.
Funding
Funding for Change Order Number 1 is available in the Road Resurfacing Program Budget, under the
General Street Improvement Fund, for an amount not to exceed $77,538.11, and under Account Number
001-5010-541.63-51 in the amount of $23,500.00 for said purposes upon approval of this change order by
the City Commission.
