R-2003- 13J­ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A VACATION OF EASEMENT OF AN EXISTING ABANDONED UTILITY EASEMENT ALONG THE NORTH PROPERTY LINE OF THE LYONS COMMERCIAL SUBDIVISION NO. 3 PLAT, SPECIFICALLY LOTS 8 AND 9, BLOCK 11 OF THE "LYONS COMMERCIAL SUBDIVISION NO. 3" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 76, PAGE 31 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO. 8-P-03); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Utility Easement described in Exhibit "A" was dedicated to the public on February 24, 1986 at the time of the recordation of the Plat; and WHEREAS, the property owner, Moshe Biton of Miami Investments, has determined that the vacation of the existing abandoned utility easement along the north property line of the "Lyons Commercial Subdivision No. 3" Plat (as depicted in Exhibit "A") is not needed in order to complete the approved site plan for the B Plaza Office Building project located at 8050 North University Drive; and WHEREAS, the City Engineer and franchised Utility Companies have been contacted and all have stated no objection to the vacation of the existing abandoned utility easement to facilitate any future improvements; and WHEREAS, the Director of Community Development recommends approval; and Temp Reso #10153 — June 5, 2003 Page 2 WHEREAS, the Planning Board recommended approval on June 4, 2003; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant a Vacation of Easement of an existing abandoned utility easement along the north property line of the Lyons Commercial Subdivision No. 3 Plat, specifically Lots 8 and 9, Block 11 of the "Lyons Commercial Subdivision No. 3" Plat, according to the Plat thereof as recorded inn Plat Book 76, Page 31 of the Public Records of Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the Vacation of Easement of an existing abandoned utility easement (attached hereto as Exhibit "A") of the Lyons Commercial Subdivision No. 3 Plat, specifically Lots 8 and 9, Block 11 of the "Lyons Commercial Subdivision No. 3" Plat according to the Plat thereof as recorded in Plat Book 76, Page 31 of the Public Records of Broward County, Florida, is hereby granted. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
