RESOLUTION NO. R-2003- J43
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
A SPECIAL EXCEPTION TO ALLOW THE
STORAGE OF TWELVE (12) MOTOR HOMES
AND FOUR (4) TRUCKS FOR REPAIR AND
RENTAL IN A B-3 (GENERAL BUSINESS
DISTRICT) ZONING CATEGORY TO U. S. AUTO
WORKS, LOCATED AT 3710 WEST
COMMERCIAL BOULEVARD, SPECIFICALLY
ALL OF TRACT "A" OF THE "INTERCITY AUTO
PLAN OF TAMARAC' PLAT, ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT
BOOK 98, PAGE 27 OF THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA (CASE NO.
1-Z-03); PROVIDING FOR CONDITIONS OF
APPROVAL; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac approves the granting of a Special
Exception to allow the storage of twelve (12) motor homes and four (4) trucks for repair and
rental in a B-3 (General Business District) zoning category, located at 3710 West
Commercial Boulevard, specifically All of Tract "A" of the "Intercity Auto Plan of Tamarac"
Plat, according to the Plat thereof as recorded in Plat Book 98, Page 27 of the Public
Records of Broward County, Florida; and
WHEREAS, the Planning Board held a public hearing on June 4, 2003 thereon and
has recommended approval of this application; and
WHEREAS, the Director of Community Development recommends approval of this
application; and

WHEREAS, the City Commission of the City of Tamarac find that approving the
petition for special exception would be in keeping with the public health, safety and general
welfare of the City of Tamarac; and
WHEREAS, the City Commission has examined and investigated the application
and staff recommendation dated June 4, 2003; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant a Special
Exception to allow the storage of twelve (12) motor homes and four (4) trucks for repair and
rental in a B-3 (General Business District) zoning category to U. S. Auto Works, located at
3710 West Commercial Boulevard, specifically All of Tract "A" of the "Intercity Auto Plan of
Tamarac" Plat, according to the Plat thereof as recorded in Plat Book 98, Page 27 of the
Public Records of Broward County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the petition for a special exception to allow the storage of
twelve (12) motor homes and four (4) trucks for repair and rental in a B-3 (General
Business District) zoning category to U. S. Auto Works, located at 3710 West Commercial

Boulevard, specifically All of Tract "A" of the "Intercity Auto Plan of Tamarac" Plat,
according to the Plat thereof as recorded in Plat Book 98, Page 27 of the Public Records of
Broward County, Florida, is HEREBY APPROVED, subject to the following conditions:
1. The applicant shall be required to pay all appropriate fees associated with the
special exception.
2. The special exception is transferable administratively pursuant to compliance
with City Codes, submitting documentation and payment of fees.
3. The Conditions of Approval as stated under Exhibit "A" (attached hereto).
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

This Resolution shall become effective immediately upon its

CONDITIONS OF APPROVAL
1. Apply for and receive approvals of all appropriate Occupational Licenses and pay all applicable
fees for the operation of a motor home and truck repair and rental business with a maximum of
twelve (12) motor homes and four (4) trucks. The Occupational License fees will be calculated
pursuant to Section 12-37 of the City Code.
2. Apply for and receive approvals for all appropriate City permits (i.e., Building) and any other
applicable permits required by any other jurisdictional agency.
3. Ensure the entire site conforms to the City's Code of Ordinances (i.e., landscaping, signage,
maintenance of buildings, etc.) relating t o this particular business.
4. Call in all inspections and receive final approvals from all applicable departments/agencies.
5. There shall be no storage of commercial vehicles visible from the abutting rights -of -way
(Commercial Boulevard). In addition, there shall be no motor homes or trucks dropped off or
parked in front of the shopping center.
6. There shall be no outside storage of vehicle parts or accessories.
