R2003-150 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING THREE REGULAR MEMBERS AND TWO ALTERNATE MEMBERS TO THE CODE ENFORCEMENT BOARD TO SERVE THREE-YEAR TERMS EXPIRING JUNE 25, 2006; PROVIDING FOR THE ELECTION OF A CHAIR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission is desirous of appointing three regular members and two alternate members to the Code Enforcement Board to serve three-year terms expiring June 25, 2006; and WHEREAS, in accordance with Section 162.05, F.S. (attached hereto as Exhibit A) members of the Code Enforcement Board shall be appointed by the City Commission to serve for three-year terms; and WHEREAS, the City Commission incorporates into the Tamarac Code F.S. 162.05, (attached hereto as Exhibit B); and WHEREAS, the Community Development Director and City Manager recommend approval; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint three regular members and two alternate members to the Code Enforcement Board. Reso. #10079 Page 2 March 19, 2003 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Section 162.05, F.S., the following are hereby appointed as regular members of the Code Enforcement Board to serve three year terms expiring June 25, 2006, or until such time as reappointments are made: C61< Vol, / 11/ - Doug DeVos Sidney Weisburd SECTION 3: That pursuant to Section 162.05, F.S., the following are hereby appointed as alternate members of the Code Enforcement Board to serve three year terms expiring June 25, 2006, or until such time as reappointments are made: Edirisinghe Amitirigala Bernard F. Barrineau SECTION 4: That pursuant to Section 162.05(4), F.S., members of the Code Enforcement Board shall elect a Chair from among the members of the board, and said Chair shall be a voting member. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or 1 E 1 Temp. Reso. #10079 Page 3 March 19, 2003 invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this 25th day of June 2003.
