A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO APPROVE AN OCCUPATIONAL
LICENSE FEE REFUND IN THE AMOUNT OF
$3,036.00 TO BE ISSUED TO FEDERAL
KEMPER LIFE ASSURANCE COMPANY, A
FOREIGN COMPANY CLASSIFIED AS
"INSURANCE COMPANY WRITING POLICY"
FOR A 2003 OCCUPATIONAL LICENSE FEE
OVERPAYMENT DUE TO A SOFTWARE
PROGRAM ERROR BY THE FEDERAL KEMPER
LIFE ASSURANCE COMPANY (CASE NO. 19-MI-
03); PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on December 5, 2002, a letter was sent to the City of Tamarac
explaining a software error and discrepancy was made in the 2002-2003 Occupational
License fees due the City of Tamarac by the remittance of Agent, Agency, Occupational
and/or Administrative License fees (attached hereto as Exhibit 1 "); and
WHEREAS, on July 23, 2003 Federal Kemper Life Assurance Company submitted
a letter requesting a refund of the Occupational License fees (attached hereto as Exhibit
"2"); and
WHEREAS, Community Development staff has determined that the Occupational
License fees were paid in error; and
WHEREAS, the Director of Community Development recommends approval of this
refund; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to authorize the appropriate City Officials to approve an
Occupational License fee refund in the amount of $3,036.00 to be issued to Federal
Kemper Life Assurance Company, a Foreign Company classified as "Insurance Compa ny
writing policy" for a 2003 Occupational License fee overpayment due to a software
program error by the Federal Kemper Life Assurance Company.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to approve an Occupational License fee refund in the amount of $3,036.00 to
be issued to Federal Kemper Life Assurance Company, located at 1600 McConnor
Parkway, Schaumburg, Illinois, a Foreign Company classified as "Insurance Company
writing policy".
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
adoption.

In reviewing our files, it appears that there has been a payment discrepancy made to the City of
Tamarac for the 2003 Occupational License fee.
Federal Kemper Life Assurance Company has remitted Agent, Agency, Occupational and or
Administrative License fees and under "Insurance Company" classification should only be
responsible for remitting Occupational License and administrative fees.
As we are doing business within the city limits of Tamarac we are responsible in the remittance
of Occupational License and administrative fees.

On December 5, 2002, a letter was sent to you explaining that there had been a software error and a discrepancy was made
in the 2002-2003 Occupational Tax License return & payment. Federal Kemper Life Assurance Company remitted Agent,
Agency, Occupational and/or Administrative License fees in error.
Federal Kemper Life Assurance Company is a Foreign Company classified as an "Insurance Company"
writing policy. Under the "Insurance. Company" classification, we are responsible for remitting only
Occupational License and Administrative fees, We are due a refund for any agent/agency license fees paid to you
because of the software error. All agents and agencies are independently licensed.
This is a second request for a refund. Please send the refund due Federal Kemper Life Assurance Company, Attn:
