RESOLUTION NO. R-2003- A 3
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO APPROVE A PARKING WAIVER
APPLICATION FEE REFUND IN THE AMOUNT
OF $2,500.00 TO BE ISSUED TO MICRON
U.S.A. CORP., OWNER OF THE SABAL PALM
PLAZA LOCATED AT 5100 WEST COMMERCIAL
BOULEVARD (CASE NO. 17-MI-03); PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on September 3, 2003 an application for a Parking Waiver was made
by Micron U.S.A. Corp., owner of Sabal Palm Plaza, located at 5100 West Commercial
Boulevard (attached hereto as Exhibit "1 "); and
WHEREAS, Community Development staff later determined that a Parking Waiver
was not necessary and informed the applicant of such; and
WHEREAS, the applicant, Micron U.S.A. Corp., has submitted a letter requesting a
refund of the application fee (attached hereto as Exhibit °2"); and
WHEREAS, the Director of Community Development recommends approval of this
refund; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to approve a Parking Waiver application fee refund in the amount

of $2,500.00 to be issued to Micron U.S.A. Corp., owner of the Sabal Palm Plaza located
at 5100 West Commercial Boulevard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to approve a Parking Waiver application fee refund in the amount of
$2,500.00 to be issued to Micron U.S.A. Corp., owner of the Sabal Palm Plaza located at
5100 West Commercial Boulevard.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

This Resolution shall become effective immediately upon its

My name is Romina Traficante and I own a shopping center in 5100 West Commercial
Blvd, Tamarac. I asked for a parking waiver on September 1" 2003 and after the staff
discussed the issue that a previous parking waiver was obtained in behalf Of my
property, I ask for a refund payment back for the $ 2,500.00 I paid.
