R-2003-�),5 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACCEPTING A QUIT CLAIM DEED FROM BROWARD COUNTY, FLORIDA, OF COUNTY OWNED PROPERTY, LOCATED IN TAMARAC, FLORIDA ACQUIRED BY THE COUNTY BY VIRTUE OF THE PROPERTY BEING DELINQUENT AD VALOREM TAX PAYMENTS LANDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property legally described as: 6-49-41 THAT PT OF SEC 6 LYING N OF SOUTHGATE BLVD & THAT PT OF SEC 6 LYING W OF NW 112 AVE LESS PT DESC IN OR 12245/856 FOR EXPRESSWAY & LESS PT DESC IN OR 12481/492 FOR PAR 135.1 B & LESS PT DESC IN 13422/107 located in the City of Tamarac, Florida has escheated to Broward County, Florida as a result of delinquent ad valorem tax payments; and WHEREAS, Florida Statute §197.592, requires land acquired by a county for delinquent ad valorem tax payments to be conveyed to the municipality in which it is located, free of any liens of record; and WHEREAS, Broward County has recorded a Quit Claim Deed for the transfer of the above described property to the City of Tamarac, Florida, a copy of the recorded Quit Claim Deed is attached hereto as Exhibit 1; and 1 Temp. Reso. #10280 October 28, 2003 Page 2 of 3 WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept the Quit Claim Deed from Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby accepts the Quit Claim Deed (attached hereto as Exhibit 1) as recorded in the Official Records Book 36245, Page 777 of the Public Records of Broward County of the property legally described as: 6-49-41 THAT PT OF SEC 6 LYING N OF SOUTHGATE BLVD & THAT PT OF SEC 6 LYING W OF NW 112 AVE LESS PT DESC IN OR 12245/856 FOR EXPRESSWAY & LESS PT DESC IN OR 12481/492 FOR PAR 135.1 B & LESS PT DESC IN 13422/107 SECTION 3: All resolutions or parts of resolutions in, conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. WHEREAS, Broward County acquired title to real property, which is described in the proposed Quit Claim Deeds attached hereto and made a part hereof as Exhibit "A," by virtue of delinquent ad valorem tax payments in accordance with the law; and 10 WHEREAS, the County, at its discretion, has decided not to sell or dedicate these lands; and 11 12 WHEREAS, the former owners of these lands have not filed a verified application or 13 petition with the Board of County Commissioners of Broward County seeking the restitution 14 of these properties in the manner prescribed by Section 197.592, Florida Statutes; and 15 WHEREAS, Section 197,592, Florida Statutes, provides that lands acquired under 16 this statute, which the Board has determined are not to be conveyed to the record fee 17 simple owner in accordance with the applicable provisions of this statute, which are located 18 within the boundaries of an incorporated municipality, shall be conveyed to the governing 191 board of the municipality in which the land is located; NOW, THEREFORE, 21 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA: Section 1. The recitals set forth in the preamble to this Resolution are incorporated 24I by reference herein. 1 Section 2. The conveyance of these properties is hereby approved for good and 2 sufficient consideration. 3 Section 3. This properties, having been acquired as County delinquent ad valorem 4 tax lands, and not having been previously sold or dedicated by the Board, and the former owners not having requested by verified application a return of such property, the 5 conditions set forth in Section 197.592, Florida Statutes, for conveying these properties are l satisfied. 9 Section 4. The Mayor of the Board of County Commissioners is hereby authorized to execute quitclaim deeds in the form attached hereto as Exhibit "A," and such other related 10 documents, if any, as needed to effect the conveyances. 11 Section 5.
