RESOLUTION NO. R2003 -S
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO GRANT UTILITY
EASEMENTS TO FLORIDA POWER AND LIGHT
COMPANY FOR THE DEVELOPMENT SERVICES
BUILDING AND FIRE STATION NO. 15 LOCATED AT
THE CITY OF TAMARAC PUBLIC SERVICES
COMPLEX; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE SAID EASEMENT;
AUTHORIZING AND DIRECTING THE CITY CLERK
TO RECORD SAID EASEMENT IN THE PUBLIC
RECORDS OF BROWARD COUNTY; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Development Services Building and Fire Station No. 15 at the
City of Tamarac Public Services Complex located at 6011 Nob Hill Road will require the
installation of electric utility lines; and
WHEREAS, the City of Tamarac, as owner of the Public Services Complex has
offered the "Utility Easement," a copy of said easement attached hereto as Exhibit 1, for
utilities; and
WHEREAS, the Director of Utilities recommends that these easements be
granted and executed; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to grant and to execute a "Utility Easement" with Florida Power

and Light Company for the Development Services Building and Fire Station No. 15
located at the City of Tamarac Public Services Complex as required for the installation
and operation of electric utilities and infrastructures.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
SECTION 2: That the appropriate City Officials are hereby authorized to grant
and to execute a "Utility Easement" agreement with Florida Power and Light Company
for the Development Services Building and Fire Station No. 15 located at the City of
Tamarac Public Services Complex to allow legal access by utility personnel in .
performing their duties, including utility installation, maintenance and operation.
SECTION 3: The City Clerk is hereby authorized and directed to record said
easement in the Public Records of Broward County.
SECTION 4.: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

The undersigned, in consideration of the payment of S 1.00 and other good and
valuable consideration, the adequacy and receipt of which is hereby acknowledged,
grant and give to Florida Power & Light Company, its licensees, agents, successors,
and assigns, an easement forever forthe construction, operation and maintenance of
overhead and underground electric utility facilities (including wires, poles, gur,
cables, conduits and appurtenant equipment) to be installed from time to time; with
the right to reconstruct, improve, add to, enlarge, change the voltage, as well as, the
size of and remove such facilities or any of them within an easement feet in

Together with the right to permit any other person, firm or corporation to attach wires to any facilities hereunder and lay cable and conduit
within the easement and to operate the same for communications purposes; the right of ingress and egress to said premises at all times; the
right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the easement area; to trim and cut and keep
aiirirried and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement area which might interfere with or fall upon the
lines or systems of communications or power transmission or distribution; and further gmts, to, the fullest extent the undersigned has the
power to grant, if at all, the rights hereinabove granted on the land heretofore described, overi along, under and across the roads, streets or
