RESOLUTION NO. R-2003- .Z 7-3
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE AN
OCCUPATIONAL LICENSE FEE REFUND IN THE
AMOUNT OF $1,352.25 AND BUILDING PERMIT
FEES REFUND IN THE AMOUNT OF $135.00 NOT
TO EXCEED A TOTAL AMOUNT OF $1,487.25 TO BE
ISSUED TO THE ST. MALACHY CATHOLIC CHURCH
LOCATED AT THE NORTHEAST CORNER OF NW
61ST STREET AND UNIVERSITY DRIVE FOR THE
OPERATION OF THE SAINT MALACHY ANNUAL
CARNIVAL CONDUCTED ON THURSDAY, OCTOBER
16, 2003 THROUGH SUNDAY, OCTOBER 19, 2003
(CASE NO. 16-MI-03); PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on September 3, 2003, the City of Tamarac received a request from the St.
Malachy Parish requesting a waiver of license and/or permit fees to conduct their annual carnival
beginning Thursday, October 16, 2003 and ending Sunday, October 19, 2003 on church property
located at the northeast corner of NW 61 Street and University Drive (attached hereto as Exhibit
"1 "); and
WHEREAS, St. Malachy Parish conducted their annual carnival to benefit the St. Malachy
Catholic Church, St. Malachy Catholic School and other worthy causes on Thursday, October 16,
2003 through Sunday, October 19, 2003; and
WHEREAS, the Director of Community Development recommends approval of the
Occupational License Fee refund; and
WHEREAS, the Building Official recommends approval of the Building Permit Fees refund;
and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best

interests of the citizens and residents of the City of Tamarac to authorize the appropriate City
Officials to approve an Occupational License Fee refund in the amount of $1,352.25 and Building
Permit Fees refund in the amount of $135.00 not to exceed a total amount of $1,487.25 to be issued
to the St. Malachy Catholic Church located at the northeast corner of NW 615t Street and University
Drive for the operation of the Saint Malachy Annual Carnival conducted on Thursday, October 16,
2003 through Sunday, October 19, 2003.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate City
Officials to approve an Occupational License Fee refund in the amount of $1,352.25 (attached
hereto as Exhibit "2") and Building Permit Fees refund in the amount of $135.00 (attached hereto as
Exhibit °3") not to exceed a total amount of $1,487.25 to be issued to the St. Malachy Catholic
Church located at the northeast corner of NW 61 st Street and University Drive for the operation of
the Saint Malachy Annual Carnival conducted on Thursday, October 16, 2003 through Sunday,
October 19, 2003.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it
shall not affect the validity of the remaining portions or applications of this Resolution.

parish grounds (6200 N. University Drive). We would like to request
permission to sell/serve alcoholic beverages at this event. In addition, we
are requesting a waiver of license and/or permit fees as they have in the
past.
