R-2003-285 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA IN SUPPORT OF THE CITY OF PEMBROKE PINES' REQUEST TO THE FLORIDA LEGISLATURE TO ADOPT LEGISLATION PERMITTING THE INSTALLATION AND UTILIZATION OF TRAFFIC INFRACTION DETECTION DEVICES AT INTERSECTIONS; AUTHORIZING THE CITY CLERK TO TRANSMITA COPY OF THIS RESOLUTION TO THE GOVERNOR OF THE STATE OF FLORIDA, EACH MEMBER OF THE BROWARD COUNTY LEGISLATIVE DELEGATION, THE PRESIDENT OF THE FLORIDA SENATE, THE SPEAKER OF THE FLORIDA HOUSE OF REPRESENTATIVES, THE BROWARD COUNTY COMMISSION, THE MAYOR OF EACH MUNICIPALITY IN BROWARD COUNTY, THE FLORIDA LEAGUE OF CITIES AND THE BROWARD LEAGUE OF CITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac supports providing municipalities with the option to install traffic infraction detection devices; and WHEREAS, the United States of Department of Transportation, Federal Highway Administration has estimated that in 2001 alone, the running of red lights cost Florida citizens approximately $375 million; and WHEREAS, in 2001, the running of red lights caused 9,111 crashes involving 107 fatalities and 12,680 injuries; and WHEREAS, although automobile crashes at intersections may be caused by many variables, the running of red lights is completely within the control of the driver; and Temp. Reso # 10308 December 4, 2003 Revision #1 — December 9, 2003 Page 2 WHEREAS, the City of Pembroke Pines has asked that the City of Tamarac support its request to the Florida Legislature providing for the installation and utilization of traffic infraction detection devices at intersections; and WHEREAS, legislation has previously been considered and defeated by the Florida Legislature which would authorize the installation and utilization of traffic infraction detection devices at intersections; and WHEREAS, the City Commission of the City of Tamarac finds it to be in the best interest of the citizens and residents of the City of Tamarac to support the City of Pembroke Pines' request for legislation which would authorize the installation and utilization of traffic infraction detection devices at intersections. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific park of this Resolution. SECTION 2: That the City Commission of the City of Tamarac hereby supports the City of Pembroke Pines' request for legislation permitting the installation and utilization of traffic infraction detection devices at intersections. SECTION 3: That the City Clerk is hereby authorized to transmit a copy of this Resolution to the Governor of the State of Florida, the President of the Senate, the Speaker of the House, each member of the Broward County Legislative Delegation, the Broward County Commission, the Mayor of each municipality in Broward County, the F 1 Temp. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 17t" day of December, 2003.
