CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2003-286
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING
PAYMENT OF A REAL ESTATE SALES COMMISSION
IN THE AMOUNT OF $59,139.12 TO CENMARK
REALTY SERVICES, INC.; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac Florida wishes to
continue to improve recreational opportunities for the residents of the City; and
WHEREAS, the City of Tamarac has sought to acquire additional land to
expand its parks program; and
WHEREAS, in 2002 the City issued sales tax revenue bonds which funds
may be used for land acquisition expenses; and
WHEREAS, the City of Tamarac authorized realtor Nat Caplan of
Cenmark Realty Services, Inc. to represent the City in negotiations to acquire, in
it's entirety or in part, the land known as Parcel P of the Lyons Industrial Park;
and
WHEREAS, Nat Caplan did negotiate and secured the donation of five (5)
acres of Parcel P of the Lyons Industrial Park to the City of Tamarac; and
WHEREAS, the value of the five acres of donated land is $1,971,304; and
WHEREAS, Nat Caplan has requested compensation in the amount of
$59,139.12, which equals 3% of value of the donated land, for his efforts to

secure the donation as detailed in his letter of November 18, 2003 hereto
attached as Exhibit A; and
WHEREAS, the City Manager recommends payment of the real estate
sales commission in the amount of $59,139.12 to Cenmark Realty Services, Inc.;
and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
remit to Nat Caplan of Cenmark Realty Services, Inc. the real estate sales
commission in the amount of $59,139.12 for securing the donation of five (5)
acres of land to the City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific
part of this Resolution.
SECTION 2:
The appropriate City Officials are hereby authorized
to remit payment in the amount of $59,139.12 to Cenmark Realty Inc. as
compensation for securing the donation to the City of five acres of Parcel P of the
Lyons Industrial Park.
SECTION 3: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or

invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
PASSED, ADOPTED AND APPROVED this 17th day of December, 2003.
