RESOLUTION NO. R-2003-289
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A
FIRE ASSESSMENT FEE REFUND IN THE AMOUNT
OF $14,359.19 TO BE ISSUED TO BROWARD
COUNTY FOR A 2004 FIRE ASSESSMENT FEE
PAYMENT MADE IN ORDER TO RECEIVE FINAL
PERMITS FOR THE TAMARAC BRANCH LIBRARY;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on October 22, 2003, the developer of the Broward County Branch
Library submitted payment of the Fire Assessment fee in the normal course of business to
complete the building permitting process (attached hereto as Exhibit 1); and
WHEREAS, on October 23, 2003, a letter was sent to the City of Tamarac by
Broward County requesting a waiver of the Fire Assessment fee for the Broward County
Tamarac Branch Library (attached hereto as Exhibit 2); and
WHEREAS, Property owned by government entities is exempt from ad valorem
taxation, and Appendix C, Section C-2(B) of the Fire Assessment Rate Resolution (R-
2003-167) provides for exemption of government owned property from the Fire
Assessment; and
WHEREAS, the Director of Finance and the City Manager recommend approval of
this refund; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to execute a Fire Assessment fee refund in the amount of
$14,359.19 to be issued to Broward County for the Fire Assessment fee payment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to execute a Fire Assessment fee refund in the amount of $14,359,19 to be
issued to Broward County, located at 115 South Andrews Avenue, Ft. Lauderdale, Florida,
for a 2004 Fire Assessment fee payment made in order to receive final permits for the
Tamarac Branch Library.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
adoption.

Dear Mr. Miller:
In the spirit of cooperation and partnership so eloquently described by Mayor Joe
Schreiber, County Commission Vice Mayor Ilene Lieberman and County Commissioner
Ben Graber, at yesterday's dedication ceremony for the new Tamarac Branch Library, we
respectfully request that the City waive the Fire Rescue Assessment Fee for this building.
Your City has distinguished itself by assisting us in achieving the successful completion
and opening of this 30,000 square foot 'state of the art' library six months ahead of
schedule. By granting the relief we request the City can further demonstrate it's
commitment to the continued cooperation we gratefully acknowledged. The savings will
enable us to offset the cost of providing additional enhancements, beyond the scope of our
program, for the benefit of the citizens of Tamarac and the entire county.
