R-2003-qg A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE REFERENDUM ELECTION VOTING AT THE MARCH 11, 2003 ELECTION ON AMENDMENTS TO THE CITY CHARTER: ORDINANCE NO.0-2002- 33 (SECTION 6.02) DELETING REFERENCES TO THE CHARTER BOARD AS ELECTED BOARD MEMBERS AND DELETING DISTRICT RESIDENCY REQUIREMENTS FOR CHARTER BOARD MEMBERS CONSISTENT WITH ORDINANCE NO. 0-2002-12; ORDINANCE NO. 0-2002-34, (SECTION 6.03) ELIMINATING REQUIREMENT OF JOINT MEETING OF CITY COMMISSION AND CHARTER BOARD FOR ACCEPTING REDISTRICTING REPORT; ORDINANCE NO. 0-2002-35, (SECTION 8.02) DELETING REQUIREMENT THAT THE CHARTER BOARD PARTICIPATE IN THE REDISTRICTING OF THE CITY, WITH REDISTRICTING OF THE CITY TO REMAIN A FUNCTION OF THE REDISTRICTING COMMITTEE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Referendum Election was held on March 11, 2003, wherein the electorate was asked to vote on amendments to the Charter of the City of Tamarac; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results Temp. Reso. #10058 March 12, 2003 2 of the Referendum Election voting at the March 11, 2003 election on amendments to the City Charter: Ordinance No. 0-2001-33, (Section 6.02), deleting references to the Charter Board as elected board members and deleting district residency requirements for Charter Board members consistent with Ordinance No. 0-2002-12; Ordinance No. 0-2002-34, (Section 6.03) eliminating requirement of joint meeting of City Commission and Charter Board for accepting redistricting report, and Ordinance No. 0-2002-35, (Section 8.02) deleting requirement that the Charter Board participate in the redistricting of the city, with redistricting of the city to remain a function of the Redistricting Committee. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following is hereby certified and declared as the official results of the public vote at the Referendum Election of March 11, 2003, for the proposed Charter Amendments: ORDINANCE NO. 0-2002-33: Amendment to Section 6.02 of the City Charter, deleting references to the Charter Board as elected board members and deleting district residency requirements for Charter Board members consistent with Ordinance No. 0-2002- 12, which created an appointed Charter Board with district residency requirements, and was approved by referendum at the September 10, 2002 election: Yes: 4,376 No: 1,614 1 Temp. Reso. #10058 March 12, 2003 3 L -- ORDINANCE NO. 0-2002-34: Amendment to Section 6.03 of the City Charter, eliminating requirement of joint meeting of City Commission and Charter Board for accepting redistricting report: Yes: 4,159 No: 1,909 ORDINANCE NO. 0-2002-35: Amendment to Section 8.02 of the City Charter, deleting requirement that the Charter Board participate in the redistricting of the City, with redistricting of the City to remain a function of the redistricting committee: Yes: 4,393 No: 1,665 SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. u Temp.
