RESOLUTION NO. R-2002-009
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE AWARD OF A
NEIGHBORHOOD BEAUTIFICATION GRANT TO THE
MAINLANDS 6 CIVIC ASSOCIATION IN AN AMOUNT NOT
TO EXCEED $3,000 FOR LANDSCAPE IMPROVEMENTS
ON N.W. 50TH STREET; AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE A MAINTENANCE
AGREEMENT BETWEEN THE CITY OF TAMARAC AND
MAINLANDS 6 CIVIC ASSOCIATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through FY02 budget process, the City of Tamarac established the
Neighborhood Beautification Grant Program as a means of providing financial
assistance to qualifying civic and neighborhood organizations for the implementation of
community based landscape and aesthetic improvements; and
WHEREAS, eight different associations attended the workshop conducted by
Public Works staff; and
WHEREAS, the Mainlands 6 Civic Association was the only entity that submitted a
grant application for consideration under this program; and
WHEREAS, the Mainlands 6 Civic Association proposes the installation of
landscape improvements in the amount of $3,000 at their community entrance way on
N.W. 50 Street, a copy of said project attached hereto as Exhibit 1; and

WHEREAS, Mainlands 6 Civic Association grant application has been reviewed and
determined to satisfy all of the criteria established as a part of the Neighborhood
Beautification Grant program; and
WHEREAS, the Director of Public Works and Assistant to the City Manager
recommend that the City award a Neighborhood Beautification Grant in an amount not to
exceed $3,000 to Mainlands 6 Civic Association; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to award a
Neighborhood Beautification Grant to Mainlands 6 Civic Association.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The Mainlands 6 Civic Association is hereby awarded a
Neighborhood Beautification Grant in an amount not to exceed $3,000 for landscape
improvements on N.W. 50t" Street.
SECTION 3: The appropriate City Officials are hereby authorized to exdcute
a maintenance agreement between the City of Tamarac and Mainlands 6 Civic
Association, said agreement hereto attached as Exhibit 2.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to

any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

To the City of Tamarac;
The residents of Mainlands Section 6 are completely in favor of and support
improving the property along both sides of NW 50th Street just east of Rock Island Road
in accordance with the City of Tamarac Beautification Project.
Section 6 is a community of 538 single-family homes with approximately 1000
residents. Our community has only two entrances. One is south of West Commercial
Blvd. on NW 50th Ave the other is NW 50th Street east of Rock Island Road.
Several years ago Section 6 improved the NW 50th Ave entranceway with the help
of funding provided by the Broward Beautification Program. The result of the
beautification of the NW 50th Ave is shown in Figure 1.

The area we are proposing to improve is the entrance on NW 50th Street east of Rock
Island Road. The Sable Palm golf course is located on both sides of the street and a golf
cart path connects hole number 2 on the north side of the street with hole number three on
the south side. The property on the north side is owned by the Golf course. We have
spoken with them about the project and they would grant us permission to landscape the
property. A similar situation existed with the NW 50th Ave beautification. The south
side of the street belongs to the City of Tamarac. Two views of the proposed area to be
improved are shown in Figures 2 and 3. A preliminary landscaping plan is shown in
Figure 4.

The area will first be excavated of all rock and undesirable material. Then topsoil will
added to the entire area. The plan includes three Queen Palms equally spaced on each side;
of the street. In between the Queen Palms will be a Date Palm, two on each side of the
street. Dwarf Schetflera will encircle each of the palms. [ledges consisting of Eugenia,
Pittosporum and Hibiscus will be placed in curving rows along the roadway. Liriope both
dark green and variegated will be used a ground cover along the roadside and in front of
the hedgerows. Extensive use of mulch will be used in all of the area not filled with plants
or trees.

A completely automatic sprinkler system will be installed and maintained by
Mainlands Section 6 Irrigation Corporation. Mainlands Section 6 Civic Association will
assume responsibility for complete maintenance of the area.
This improvement would be a very attractive enhancement to the Mainlands
Section 6 as well as the City of Tamarac. We would be very appreciative to the City to
provide our community with Grant funding to move forward with this project.
This package includes, a location map of the proposed project, project description
with photographs, plant material list, design and construction plans, evidence of not -for -
profit status, evidence of community support and the executed maintenance agreement.

Maintenance Agreement
Between
The City of Tamarac
And
Relating to the Project at

This Agreement between the City of Tamarac, a municipal corporation with
principal offices located at 7525 NW 88 Avenue, Tamarac, Florida 33321
(hereinafter "CITY") and _Asaoc,, a

Florida 333 IN -(hereinafter "GRANTEE") is made and
entered into this day of , 200___
WITNESSETH
WHEREAS, the City Commission of City of Tamarac established the
Neighborhood Beautification Program Grant for the purpose of providing
funding to assist civic and neighborhood groups to bring practical solutions to
the aesthetic problems in the community; and
WHEREAS, the Grantee has submitted an application for the Neighborhood
Beautification Grant for the purpose of e

(hereinafter "Project") within the City of Tamarac and was
awarded grant funding by the City for said Project; and
WHEREAS, the City and the Grantee are of the opinion that said area of the
Project should be landscaped and/or revitalized to improve and enhance the
aesthetic quality of the proposed Project and the area encompassing the right -
of way; and
WHEREAS, the right-of-way, consisting of road improvements and grassed
areas abutting thereon, located between SAg L LM -�. �. — and
'- S , is owned by either the City or Broward County; and
WHEREAS, if said right-of-way is owned by Broward County, Grantee has
obtained and submitted to City the proper authorization or permit from Broward
County to use the right-of-way for the Project;
WHEREAS, the City and the Grantee recognize the need to enter into an
agreement to govern the maintenance of the proposed Project.

NOW, therefore in consideration of the mutual terms and conditions, promises
and covenants hereinafter set forth, the City and Grantee agree as follow:
1. The foregoing recitals are true and correct and incorporated herein.
2. The Grantee shall not add, remove or change plant material and/or any
structure after Project has been approved unless authorized by the City.
I The Grantee shall be the owner of the planting and other installations
included and stipulated in the grant application, attached hereto as Exhibit
A; however, Grantee agrees that the City may remove or alter the
plantings and installations if necessary for the health, safety and welfare of
the citizens of the City of Tamarac.
4. The Grantee agrees to follow the guidelines established in the
Neighborhood Beautification Grant Program information and guidelines,
attached hereto as Exhibit B,
5. The Grantee shall maintain the Project in a responsible manner and with
due care, including but not limited to, the following:
a. Proper watering and fertilization of all plant materials, keeping them as
free as practicable from disease and harmful insects;
b. Proper mulching of the plant material bedding;
c. Keeping the premises free of weeds and litter;
d. Mowing and cutting grasses to proper length;
e. Proper pruning of all trees, including removing dead or diseased parts
of trees or pruning such parts thereof which present a hazard;
f. Removing and replacing dead or diseased plant materials in their
entirety, or removing and replacing those that falls below original
Project standards.
6. The Grantee agrees to repair, or remove and replace at its own expense
all or part of the Project that falls below Project standards.
7. The Grantee agrees to replace parts with parts of the same grade, size
and specification as provided in the original plans for the Project, in the
event any part or parts of the Project, including all plants, must be
removed and replaced.

8. The Grantee agrees to periodic inspections of the Project to be performed
by the City. In the event that any of the above -mentioned responsibilities
are not carried out or are otherwise determined by the City not to be in
conformance with the applicable Project standards, the City, in addition to
its right of termination under Paragraph 9, may at its option perform any
necessary maintenance without need of any prior notice and charge the
costs thereof to the Grantee. This paragraph shall survive the termination
of this agreement.
9. This agreement may be terminated under any one of the following
conditions:
a. By the City, if the Grantee fails to perform its duties under this
agreement within fifteen (15) days of receipt of written notice from the
City.
b. By either party following a sixty (60) day written notice of intent to
terminate.
10. Upon termination, or anytime thereafter if Project is not maintained by
Grantee, the City shall, at its option, continue the maintenance of the
Project, or remove part or all components of the Project, if necessary, for
the health, safety and welfare of the citizens and residents of Tamarac.
11. In the event this agreement is terminated in accordance with Paragraph 9
then the Grantee shall refund to the City a pro -rated portion of the grant
award based upon the following schedule:
a. If termination occurs within one year after completion of Project, 75%
of the grant award;
b. If termination occurs during the second year after completion of
Project, 50% of the grant award;
c. If termination occurs during the third year after completion of Project,
25% of the grant award;
12. The Grantee covenants and agrees that it will indemnify and hold
harmless the City and all of the City's officers, agents, elected officials and
employees from any claim, loss, damage, rent, charge or expense arising
out of any act, neglect or omission by the Grantee during the performance
of the Agreement, whether direct or indirect, and whether to any person or

property to which the City or said parties may be subject, except that
neither the Grantee nor any of its subcontractors will be liable under this
paragraph for damages arising out of injury or damage to persons or
property directly caused or resulting from the sole negligence of City or
any of its officers, agents or employees.
13. Grantee shall hold harmless and indemnify the City from and against all
claims, liability and expense arising from the encroachment of any
easements by landscaping and/or structures, including the expense of
removing, relocating, restoring and replacing same.
14. The City shall be held harmless by Grantee and shall not be responsible
for the damage, destruction or replacement of irrigation lines within utility
easements in connection with the Project.
15. This agreement may not be assigned or transferred by the Grantee in
whole or in part without consent of the City.
16. This agreement shall be governed by and construed in accordance with
the laws of the State of Florida. The venue for any legal proceeding
brought pursuant to this agreement shall be Broward County, Florida.
17. Whenever either party desires or is required under this agreement to give
notice to any other party, it must be given by written notice, sent by
certified United States mail, with return receipt requested, addressed to
the party for whom it is intended at that party's last specified address, and
such address shall remain the same until written notice of any change in
address is received by either party from the other, at which point, such
new address shall become the last specified address. For the present, the
parties designate the following as the current addresses for giving notice:

Grant Information and Guidelines
1. City will match 50% of total project costs, up to a maximum of $3,000.
* Applicant shall submit a complete set of plans with application.

be reimbursed (up to 10% of project costs).
2. Only beautification and landscaping projects will be considered.
❑ Project must be on public right-of-way within the City of
Tamarac.

4. Funds will be dispersed on a reimbursement basis only, upon completion

7. City will not manage any project on behalf of recipient.
8. The involvement of the City will be to award funds through a selection
committee and ensure that work corresponds to submitted application.

9. The Public Works Department will serve as City's contact once awarded.
10. The selection of applicants will be done through a committee formed of
three members:

❑ Community Development designee
❑ City Manager designee
11. Applicant agrees that the decision of the selection committee is final
12. Applicant will be responsible for obtaining required State, County, and/or
City permits as necessary. Approval of plans and grant award do not
waive any permitting responsibilities.
❑ If project is selected for funding, City will waive its permit fees.
13. Project must be completed and reimbursement request submitted by
August 31, 2002.

14. Applicants will be responsible for all maintenance and care of project
during and after construction.
15. Organization will provide before and after color photographs of the project.
16. Selection will be based on a point system (100 points) on specific criteria.

17. City of Tamarac Landscaping Requirements
❑ Plant materials must be selected from the City's master
landscape plan proposed list.
❑ Obstruction of visibility remains a great concern of right-of-way
projects. Plant selection shall address this issue.
