R-2002-33 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT THE OFFICIAL 2001 APPROPRIATION IN THE AMOUNT OF $366,000.00 TO THE CITY OF TAMARAC'S U. S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM FOR THE HUD FISCAL YEAR FY- 2001 (CASE NO. 3-MI-02); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the U. S. Department of Housing and Urban Development (HUD) has notified the City of Tamarac of the official allocation of its HUD Fiscal Year FY 2001 in the amount of $366,000.00 under the Community Development Block Grant (CDBG) Program (attached hereto as Exhibit A); and WHEREAS, this amount is $13,000.00 over the anticipated allocation based on the previous year's funding; and WHEREAS, allocations received for the Community Development Block Grant (CDBG) Program must be utilized for eligible CDBG activities; and WHEREAS, all eligible Community Development Block Grant Program activities must also meet one (1) of the two (2) "national objectives" as defined by Congress as either benefiting low and moderate income people or helping to eliminate slum and blight; and WHEREAS, on July 12, 2000, by Resolution No. R-2000-203, the City of Tamarac January 29, 2002 - Temp Reso #9671 2 Revision No. 1 — February 5, 2002 adopted the City of Tamarac Consolidated Plan, a required document which established a Five Year Strategic Plan listing the applicable priorities for the CDBG Block Grant Program; and WHEREAS, on July 11, 2001, by Resolution No. R-2001-198, the City of Tamarac adopted the Action Plan outlining the programs to be funded during the upcoming year based on the anticipated budget of $353,000.00; and WHEREAS, according to this Plan, 17 '/2 % of the budget is to be set aside for administration and the remainder is to be used for eligible program activities; and WHEREAS, the budget must be amended to include the additional amount of $13,000.00 in the official allocation (attached hereto as Exhibit B); and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to accept the official 2001 appropriation in the amount of $366,000.00 to the City of Tamarac's U. S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program for the HUD Fiscal Year FY 2001. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 1 LJ January 29, 2002 - Temp Reso #9671 3 Revision No. 1 — February 5, 2002 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission authorize the appropriate City Officials to accept the official appropriation in the amount of $366,000.00 for the City of Tamarac's U. S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program utilizing the additional $13,000.00 amount in eligible expenditures for the HUD Fiscal Year FY 2001. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: passage and adoption. The grant assistance that is being approved with the Action Plan is as follows: Community Development Block Grant (CDBG) Program $366,000. The total allocation for your community is $366,000. Your FY 2001 program year begins on October 1, 2001. We would like to take this opportunity to commend the City on the successful completion of the one year Action Plan. We believe that the goals and objectives developed through this process provide the foundation for the formulation of hew' partnerships at all levels of government and with the private sector including for -profit and non-profit organizations. These partnerships are invaluable as you and your partners address the problems of affordable housing, homelessness, and economic opportunities for all citizens, particularly for very low-income and low-income persons. Enclosed are three originals of each of the required Grant Agreements and Funding Approvals. This constitutes the contract between our Department and the City. You should note any special conditions listed in the Funding Approvals. Please return two executed originals for each Grant, and retain the others for your records. The recipient shall also complete the review procedures required under E.O.12372 and 24 CFR Part 52 and receive written notification from HUD of the release of funds before obligating or expending any funds provided under this agreement for any new or revised activity for the planning or construction of water or sewer facilities not previously reviewed under E.O.12372 and implementing regulations. Which includes CDBG. Integrated Disbursement Information System (IDIQ The Community may add or delete individuals authorized to access the Integrated Disbursement and Information System (IDIS). An IDIS Access Request Form must be prepared, notarized and returned to this office with the Grant Agreement. The Direct Deposit sign-up Form (SF-1199A) must be completed: if there is the need to establish or change banking information. Both the Grantee and the financial institution must complete the form. The completed SF1199A Form must be returned to this office. Environmental Review Procedures Certain activities included in the Consolidated Action Plan are subject to the provisions of 24 CFR Part 58 (Environmental Review Procedures for the CDBG Program). Funds for such activities may not be obligated or expended unless the release of funds has been approved in writing by HUD. A request for the release of funds must be accompanied by an environmental certification. Appropriate forms are enclosed.
