R2002-46 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING ONE (1) REGULAR MEMBER TO THE CONSUMER AFFAIRS COMMITTEE TO COMPLETE AN UNEXPIRED TERM ENDING JUNE 27, 2002; APPOINTING ONE (1) ALTERNATE MEMBER TO THE CONSUMER AFFAIRS COMMITTEE TO COMPLETE AN UNEXPIRED TERM ENDING JUNE 27, 2002; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Lenore Langer was appointed to serve as a regular member on the Consumer Affairs Committee on June 27, 2001 (Resolution 2001-170, attached as Exhibit A); and WHEREAS, Lenore Langer has resigned from the Consumer Affairs Committee; and WHEREAS, Sandy Fyfe was appointed to serve as an alternate member on the Consumer Affairs Committee on June 27, 2001 (Resolution 2001-170, attached as Exhibit "A"); and WHEREAS, Sandy Fyfe has not been able to attend any meetings of the Consumer Affairs Committee; and WHEREAS, Section 2-31(b) of the Tamarac Code (attached as Exhibit "B") states in pertinent part: "(b) If over a period of seventy-five (75) consecutive days excluding the month of July, a committee or board member should be absent from all the regular meetings of the committee or board to which he has been appointed by city commission, the member shall be deemed to have forfeited his appointment."; and Temp. Reso. #9654 Page 2 January 8, 2002 WHEREAS, in accordance with Sections 2-106 and 2-107 of the Tamarac Code (attached hereto as Exhibit "C") nine (9) regular members and two (2) alternate members of the Consumer Affairs Committee shall be appointed by the City Commission to serve one (1) year terms; and WHEREAS, the Public Information Officer and City Manager recommend approval; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint one (1) regular member, and one (1) alternate member to the Consumer Affairs Committee to complete unexpired terms ending June 27, 2002. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Section 2-107 of the Tamarac Code, the following person is hereby appointed as a regular member of the Consumer Affairs Committee to complete an unexpired term ending June 27, 2002, or until such time as reappointments are made: Herman R, Weiss SECTION 3: That pursuant to Section 2-107 of the Tamarac Code, the following person is appointed as an alternate member of the Consumer Affairs Committee to complete an unexpired term ending June 27, 2002: Eli Schneider Temp. Reso. #9654 Page 3 January 8, 2002 SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this 25th day of February, 2002.
