CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R2002-47
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPOINTING ONE (1) MEMBER TO THE
AMBULANCE COMMITTEE TO COMPLETE AN UNEXPIRED
TERM ENDING JUNE 27, 2002; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Moshe Levene was appointed to serve as a member of the
Ambulance Committee in June 2001(Resolution 2002-167 attached as Exhibit
"A"); and
WHEREAS, Moshe Levene has been unable to attend meetings of the
Ambulance Committee over a period of seventy-five consecutive days; and
WHEREAS, Section 2-31(b) of the Tamarac Code (attached hereto as
Exhibit "B") states in pertinent part:
"(b) If over a period of seventy-five (75) consecutive days excluding the
month of July, a committee or board member should be absent from all the
regular meetings of the committee or board to which he has been appointed by
city commission, the member shall be deemed to have forfeited his
appointment."; and
WHEREAS, Sections 2-233 and 2-234 of the Tamarac Code (attached
hereto as Exhibit "C") provides that seven (7) members of the Ambulance

Committee shall be appointed by the City Commission to serve one (1) year
terms; and
WHEREAS, the City Commission is desirous of appointing one (1)
member to the Ambulance Committee to complete an unexpired term ending
June 27, 2002; and
WHEREAS, the Fire Chief and City Manager recommend approval; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in
the best interest of the citizens and residents of the City of Tamarac to appoint
one (1) member to the Ambulance Committee to complete an unexpired term
ending June 27, 2002.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of
this Resolution.
SECTION 2: That pursuant to Sections 2-233 and 2-234 of the Tamarac
Code, the following person is hereby appointed as a member of the Ambulance
Committee to complete an unexpired term ending June 27, 2002, or until such
time as reappointments are made:
Seymour Bauer
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon
adoption.
